How are you getting screen shots?Even if top of bail, it looks less than 50% to me (but hard to tell exactly) based on the white lines (that I drew myself) below. Still think this should be out and the 50% rule is a bit dumb in this situation when it is 3/4 inside leg stump, and hitting half a bail. That should be enough.

Where you've drawn that line is clearly below the top of the bail and it looks like >50% under your line, to my eye, which would consititute an over-rule of the umpire's decision if I had my way of using the "top of the bail"... but yeah, I agree the rule could do with a bit of tweaking when it comes to the umpire's call zone for height.Even if top of bail, it looks less than 50% to me based on the white lines (that I drew myself) below.
