James Hird's lawyers have launched a formal challenge to the Australian Sports Anti-Doping Authority, claiming that the interim report the government agency prepared for the AFL is invalid, and citing no less than 27 points of conjecture to items in the 400-page document.
Hird has also reiterated in writing that chief executive Andrew Demetriou is a conflicted party who should not sit in judgment of the matter.
In correspondence lodged with the AFL's solicitors on Wednesday afternoon, Hird's legal team outlined three demands that would ruin the league's plans to deal with Essendon before the finals series.
An August 19 deadline was set for an AFL response, with the Hird camp - including Julian Burnside, QC - making no secret of its intention to take on the league in the Victorian Supreme Court if necessary.

To be expected but Hird did say that he would be fighting the charges vigorously.

It's a hail mary, albeit expected, move from the Hird camp.

I doubt anyone seriously expects it to succeed in accomplishing anything other than delaying the process.

The AFL is the governing body of the sport, and all clubs, players, and officials are party to it's policies and regulations.

If any judicial process somehow determined that the AFL was not a legitimate authority in this matter, as it appears Hird is challenging if you get to the crux of the issue, then that's basically the end of the entire AFL as we know it.

And no, that's not being melodramatic.

Well I think it is being melodramatic.

The AFL have chosen to charge Hird based on the contents of this report.

If he feels its inaccurate, this is the right course to take.

But it's not. The AFL have charged him, AND given him a time and date for him to fight the charges.

Instead of fighting the charges on their merits as they have been presented, he has launched legal action to avoid facing the charges put before him.

In short, it seems from the outside that James Hird is receiving terrible legal advice.
