It is written into the rule, but that is what makes the rule stupid.

The rule should be simple; 

No prior and you hold the ball = ball up

No prior and you drop it or it gets knocked out = free against

Prior = free against

It should be that simple. The bullshit rule when it can accidentally come out is a joke and creates all the problems.
