Why are we still going on about the settlement?
It has been found (on the balance of probabilities) that Higgins was r*ped in a ministers office. The fact that this occurred, or was allowed to occur, is clear evidence that the processes put in place to protect employees in parliament house was...
Maybe Reynolds is shooting for her own settlement payment for an unsafe workplace?
I said that as a joke, but the more I think of it the more the evidence presented by Reynolds in this trial makes sense....
Thanks for that Kurve
Has anyone done a timeline on this one?
I'm particularly interested in the comment in the article that states Rachael Young SC argued that damage suffered in 2021 can have no basis in posts made in 2023.
Obviously if this is correct, what is the harm caused by the...
The issue re the DNA is not if it would still be there or not. The issue is how can the prosecution prove that it came from Leahrman on that night and in the circumstances posed by the prosecution given the amount of time that has passed.
If the DNA evidence was presented after all this time...
The transcripts do make mention of Farquarson having a previous coughing episode where the car gently rolled on after he tried to stop. He did not pass out at that time however and merely took his foot off the brakes. This sword cuts both ways though, is it proof of a medical issue, or is it...
I believe that there was the text message directing Whybrow to ask a certain question? If thats wrong I'm happy to be corrected.
Look, the motivation could have been Reynolds in full arse covering mode (i.e. "I want the transcript so I can see if she dobbed on me"), but that is still...
Wow... where to start....
Reynolds obviously held private and confidential information about the (on balance of probabilities) rape, and about Higgins purely as a result of her position and the meeting(s) she held with Higgins. And then in the middle of a rape trial, Reynolds was sending text...
Is this the first time this has come to light?
For Reynolds to be sending text messages to Lehrmann's barrister is so improper I'm struggling to find sufficient adjectives to describe it.
Why would Reynolds be pushing to report the incident to police if she didnt 'know anything for sure'?
Doesnt this undermine Reynolds' claim that she was not aware prior to the meeting in the office where Higgins was, on the balance of probabilities, r*ped?
Hi Figjam
The easiest way to access is on Jade, with the Court of Appeal decision here: https://jade.io/article/287368
FYI, if you havent used Jade before, you can scroll to the bottom and it will give you the links to all the Court history.
Anyone swayed by the podcast should probably take a read through the original trial, the re-trial, the 2010 judgement and the appeal. A great deal of the 'inconsistencies' and 'unanswered questions' that have been suggested in the podcast have actually been dealt with.
Yep, the odds are bugger all, I'm not disagreeing with that.
All I am trying to do is clarify how the not guilty/guilty verdict is not flawed.
For instance, consider the following scenario: Lynn and Hill are wrestling over the gun, Hill has a heart attack and drops dead, Clay starts...
That tracks, but if you dont believe Lynn's version of events, that does not automatically mean that the jury can find him guilty beyond reasonable doubt on both counts.
It was clear and agreed by the parties that Clay died from a shotgun slug to the head which was fired from Lynn's gun...
Just reading the ABC article, and Dermot Dann is quoted as saying (Lynn) "maintains that he's never killed any person, at any time, at any place, anywhere, ever"....
Somewhat strange that the defence has been expanded to 'any person... ever'.... Does Lynn get access to Bigfooty in the clink?
Its not as simple as if the jury believed that he lied or did not lie.
The two charges are separate and the jury has done their job properly by not conflating them.
The Jury could have thought that Lynn lied out his arse, but that alone is not sufficient for the jury to find Lynn guilty...
It was my understanding that only the eldest son had his seatbelt undone, and that it appeared he was trying to rescue his brothers.
The Dr who appeared at trial for the defence was the one who raised the coughing syncope, and is quoted that Farquharson told him that he "didnt know what...
The same Dr gave evidence of coughing syncope at the original trial as well. That evidence was rejected. It is not new and compelling evidence and far from sufficient to re-open the matter.
I have just had a quick look over the Coroner's findings in the inquest into Catherine Viergever's death. The Coroner mentions that there was a degree of financial stress, which could have been the motivation for the 'murder-suicide'. There was a proper crime scene investigator on the scene, and...
Hi HC
Hope this helps, and happy for anyone else to add their experiences as well
The shotgun used by Lynn has a magazine that holds the shells. So assuming the magazine was already full, Hill would have to have the magazine the right way around, then there would be a little tab/catch that...
If we go down the 'loss of memberships' path, it really highlights the lie(s).
If a pilot makes a mistake it could lead to the deaths of hundreds of passengers. Because of this, pilots (and more so check pilots) are trained to be transparent and to take responsibility if there are issues...
There are two separate charges for murder. This means that each death will need to be considered in its own right, so yes, possible to not be unanimous for RH (hung jury) and guilty for CC
Nope, unless you were in the Court room for the full duration of the trial, you would not have heard or seen all of the evidence. The media focus on what will get clicks (such as the affair), and not necessarily what is relevant to the case at hand. This means the evidence we receive as the...
Ok, so lets straighten it out over old Brucey Boy.
Bruce Learhman commenced defamation action against channel 10 because channel 10 called him a rapist on TV. Channel 10 said it cannot be defamation because it was true (i.e. Bruce r*ped Brittany). Bruce's highly qualified and highly paid...
This. There is plenty of evidence and studies that show many women do not come forward as they think no-one will believe them. Not to mention the serious mental trauma that would come from having to face your attacker when giving evidence.
We are not saying that there have not been incidents...
