At least we know what stage the hearing has reached if nothing else. To take around 3 days on his opening submissions seems to indicate ASADA may be outlining a complicated case. Hard to conjecture if thats good or bad for the players.

I thought they were supposed to rock up and say we've got nothing, case dismissed?

Players' response

The players have remained steadfast in their belief that the injecting program used no illegal substances. Should the tribunal find otherwise, the players would argue that any illegal administering by Dank was done without their knowledge and consent – and despite several attempts on the players' behalf to ensure the program complied with all relevant drug codes.
In the event the tribunal finds against them their fallback position seems a bit precarious for a couple of reasons. (1) Many athletes have tried to play this angle, only to be thwarted by the strict liability provisions. (2) Given that none of the players thought to contact ASADA regarding the status of the drugs they were given ASADA could argue pretty strenuously that the players did not exercise reasonable care.

The term "illegal administering" also raises my eyebrows. I suspect this term might have been invented by the reporter as it has all sorts of legal ramifications if that is really the tack the players are going to pursue.

They'll only get off on ground 1.

Youre spot on with strict liability and the fallback. The argument posted above only leads to a 'reduced fault' reduction in sanction (maybe).
 
And so the circus continues. ASADA has not gathered any direct evidence that Ess players were injected with TB4. Its own investigators recommended the case be dropped.

Spare us the bile...Your bias is very evident. Let those in the court deal with it now.
 
So basically Essendon's reps don't get to speak until next year because ASADA will be hogging the room for the next 2 days?

More delays.


Mmmmmm Bloody ASADA Gee they have been a pain with their delays...This time they are going to take THREE days to layout exactly what took place with this 'program" at Essendon. Have they got no Christmas spirit for poor Essendon.
