THE AFL is facing its most jittery and troublesome few months as it awaits the Court of Arbitration for Sport’s hearing on the Essendon doping scandal.

Bombers fans buoyed by the AFL Tribunal’s not guilty verdict are on high alert and in defensive mode. No matter what they claim about being dragged through an unnecessary new hearing, the CAS will not offer the 34 Essendon players any special considerations as it ponders their guilt or innocence over the needles program at the club in 2012.

Those sports fans who today feel numbed by the more than two years of hand wringing and ASADA investigations into the Bombers should be watching the next developments with renewed interest.

This hearing will not be conducted by one of their own. It will not be AFL people judging other AFL people on whether the club oversaw a program that involved the injection of 4000 needles in the 2012 season.

The CAS do not skirt around player welfare issues or offer special consideration to the AFL. They do not ask ASADA to jump through so many hoops that the burden of proof is impossible to scale.

The CAS makes it the sole responsibility of the athlete to prove his innocence without reasonable doubt. As it has been for every individual drug cheat snared by world doping agencies, these 34 will face the same grilling as a Russian hurdler, Chinese swimmer or American cyclist.

The evidence that the AFL said they simply could not accept will be fully admissible at the CAS. Written statements from suppliers and chemists, pretty much disregarded at the AFL tribunal, will be admissible.

Eh, spot on article, however pointless article.

I can bet any money that the bombers are catching on the "The CAS makes it the sole responsibility of the athlete to prove his innocence without reasonable doubt". All that implies is that the player needs to help prove their innocence, not just sit there and cop what ASADA say (which is what they done at the AFL tribunal, thats why they have lawyers)

If she didn't marry John Hartigan, she wouldn't have a job. What a load of emotive, factually incorrect, wishful tripe.

Looks like she's been on the turps again. Hopefully not driving past any schools this time.

Hird and his sympathisers have nothing to complain about. He and the players agreed to be bound by the WADA code when they decided to be coaches/players. They agreed then that WADA would have the final say in this sort of investigation.

They also agreed that the WADA rules were part of the rules of the game. If they don't want to play by the rules they can walk away at any time.

Hird is a qualified stock broker and civil engineer and has just recently finished a high end business degree in France. He has business interests outside the AFL.

He remains a coach bound by the WAD code by choice, not necessity.

If he doesn't like it he can leave.

Look, I get that you are pissed at her... but fair dinkum this stance is so archaic. Women don't just get jobs because they are rooting some powerful bloke. She was actually "born" into the industry with her dad a former news limited reporter, and her brother a sports journo. She's been in the industry for 20+ years. Hartigan is her second marriage, so she was in the industry some 10 years before she married him. Whether you think she's any good or not at her job is irrelevant. She isn't there just because she's rooting an ex news limited boss.

I might also add, she's not the only person ever to have had a drink driving offence.

That's a moot point in relation to the situation the EFC players find themselves in. They are bound by the code to ensure that nothing prohibited enters there system but they have admitted to being injected with substances whose provenance they failed to establish.

There is a question before ASADA right now as to whether an athlete who allows himself to be injected with a substance whose identity is unknown, or that is untraceable, inadequately described, or inadequately recorded, has fulfilled his personal duty under clause 2.2.1 of the WADA code.

Agree totally.

Should point out though, I think she is a truly awful journalist and always has been. However, fair is fair. Robbo is worse, as anyone who read his thing about Mick Malthouse and the Alamo this morning will know. And I'm pretty sure he can't have been given his job for rooting someone.

You don't like her because she is having a go at Essendon. I'm not a huge fan, but she's not the worst I've seen. Only have to look at Robbo and Rucci to find two male versions that make her look like Joseph Pulitzer.

That's all true but they have been charged with using tb4. Does CAS have the authority to hear charges of record keeping? I didn't think they could but am happy to be corrected.

Lawyers claiming that Dank and others will be called up (Justice Croft didn’t call them up in the local trial, as it was deemed ‘domestic’ but Dank and Charter lose that right, as its now international.

Also, the Laywers are citing a case in Germany, where an Ice Skater is going to get done, and that the German case involves ‘a lack of records’.

Very very interesting show.
