'Editorial: Sharon Fulton deserves justice

The West Australian

'Someone out there knows what happened to Sharon Fulton.
Someone out there knows where she is.
It’s been 37 years since Ms Fulton disappeared from her Duncraig home, leaving her four children with nothing more than fading memories of their devoted mother.

Her youngest Heath, just three when Ms Fulton went missing, barely has that. More of a feeling of safety, he tells STM, as his mother stood over his cot when he was toddler.
He has spent almost his entire life wondering about this woman he barely remembers.
“There is nothing more I want in life than the truth to what happened to Mum,” he says.

Sharon’s story is a tragic tale made even more distressing by the fact it is so familiar. It calls to mind the disappearances and presumed murders of other women, including Sydney’s Lynette Dawson.
Both women’s bodies have never been found.
In another similarity with the Dawson case, a coronial inquest found that Ms Fulton’s husband Robert was “directly or indirectly” involved in his death.
But while Ms Dawson’s family finally found closure when a court last year found her husband Chris guilty of murdering her in 1982, Ms Fulton’s family has only questions, and anguish.

Mr Fulton did not appear at his wife’s inquest, despite being summonsed.
He himself has now vanished, ignoring attempts from both police and STM to reach him.
But in an email to the Coroner’s Court earlier this year, Mr Fulton, now in his 70s and last known to be living in Queensland, denied killing his wife.
Still, in light of the court’s findings, WA’s Director of Public Prosecutions is considering whether criminal charges can finally be laid.

A successful prosecution would finally bring some level of closure to Ms Fulton’s children, still suffering all these decades after they were made to believe she had walked out of their lives.

It would also go some way to making amends for the botched initial investigation.
“There is no excuse for the lack of police work,” Heath says.
“There were several clear red flags that were not followed up on. This was basic investigative work that went missed and there has been no accountability for it.”

Heath’s message to whoever knows what happened to Ms Fulton is to show some compassion.
“Whoever was involved in her death has lived their life for the last 37 years knowing they have caused my siblings and I so much pain and torture by not knowing what happened to our mother.
“That person would be old now. They have an opportunity to bring us some small comfort in providing the truth.
“Just as much as good people can do evil things, evil people can do good things too.
“What we need is to bring her to peace and to move on, knowing we can lay her body to rest and have somewhere that we can visit her.”

Though the stories of both Ms Fulton and Ms Dawson are ones of immeasurable sadness, that Ms Dawson’s killer was finally brought to justice also offers hope, that one day Ms Fulton will be afforded the same dignity.'

Interesting that the ABC is reporting that the man cannot be named for legal reasons
Almost 40 years after Sharon Fulton vanished in Perth, a 77yo man has been charged with murder

And the coroner's report is no longer appearing on the website.
A previous ABC report gives the summary finding that she was the victim of a homicide, and that her husband was involved "either directly or indirectly" in her death.

This is a pisstake surely?

Worst thing is that he probably uses that name because Sharon Fulton is a FBI psychiatrist in the show.

It is interesting that at the time of the inquest this was reported so maybe it wasn't entirely accurate.

"Ms Linton declined to issue a warrant for Mr Fulton's arrest, saying it would have been an exceptional move and any evidence he would have given would have been problematic because of his Alzheimer's diagnosis."

Raymond Reddington?! From Blacklist. What a flog.

Cops reportedly used the Mr Big sting to get the evidence needed so they'd want to be pretty damn sure he doesn't have Alzheimer's because there's no way that stands up in court if he does.

Source? my understanding is everything is now being suppressed by court orders. I'm interested how they finally got enough evidence to arrest him. would have to guess he has said something to someone, or someone tipped him in it. body apparently still not found.

My mistake, misread the headline. Mr Big was used for the murder of Rachel Michael to catch the (distinctly unaffected by dementia) Adam Vidot.

Too many murders to keep straight :(

They had enough evidence at the Inquest for a Warrant. The medical stuff was just of concern.

The similarities between this case and the Lynette Dawson murder is incredible.

Tim Clarke published the below this afternoon, and it's currently not behind the paywall.

The man appeared in court can no longer be named. I wonder if the man who can no longer be named has changed his name again.

He is going to fight the charge. He will next appear in court in January.

I've heard of a horse with no name

But Clint Eastwood perfected the man with no name in his trilogy of movie classics, that included what could well be a motive for the disappearance of Sharon Fulton: A Fistful of Dollars

Next July's murder trial of Sharon Fulton's ex-husband just got even more interesting.

'David and Catherine Birnie: Man accused of murdering Sharon Fulton wants to test serial killers’ exhibits

Phil Hickey The West Australian
Mon, 21 October 2024 6:30AM
...
Decades-old exhibits relating to the Birnies’ evil crimes are being pursued by Raymond Reddington’s lawyers as he fights allegations he murdered his wife Sharon Fulton in 1986.

Mr Reddington, who changed his name from Maxwell Robert Fulton, was arrested this time last year by cold case detectives in relation to his missing wife’s death nearly 40 years ago.

The 78-year-old was subsequently charged with the wilful murder of the devoted mum of four, whose body has never been found.
...
Mr Reddington pleaded not guilty to the wilful murder charge earlier this year. He remains in custody and is due to stand trial in July.

Now, court documents obtained by The West Australian reveal Mr Reddington’s lawyers believe they have acquired “very substantial” material about the Birnies and were now looking into whether they are “a credible alternative perpetrator”.

The West can reveal Mr Reddington’s lawyers and the State prosecutors handling the case have discussed at the length the killer couple – who killed four women in the same year Ms Fulton disappeared.

Most of those discussions have revolved around whether or not any exhibits connected to Birnie cases have ever been tested for Mrs Fulton’s DNA.

And in transcripts of Mr Reddington’s June 24 hearing in the Supreme Court his defence lawyer Jonathan Davies told the court he and his legal team were now studying Birnie material, which was about 900 pages in length.

“We have … received very substantial disclosure concerning the infamous David and Catherine Birnie, who were active … in offending during the relevant period,” Mr Davies told the court.

“And the case will very much, we expect be looking at whether they are a credible alternative perpetrator for the disappearance of Ms Fulton.”

On September 26 this year, a further status conference hearing was held in the Supreme Court about the case.
During that hearing State prosecutor Ben Stanwix confirmed a “large amount of disclosure” had been provided to Mr Davies in relation to the Birnies.

At Mr Davies’ request, Mr Stanwix said “testing of any materials” seized from the Birnie home in 1986 had also been “actioned.”

“If Mrs Fulton’s DNA turns up on one of those items, then we won’t be having a trial one would imagine,” Mr Stanwix told the court at one stage.

But Mr Stanwix explained to the court WA Police had no boxes in its possession connected to the Birnie cases.
“I’m told that there is not a single Birnie box that is in the possession of … WA Police, that’s the issue,” Mr Stanwix told the court, adding: “The Birnie case theory is not one that the State intends to give a great deal of attention to.”

But Mr Davies told the court on September 26 he still wanted to know what items might be available for testing.
“What I do foreshadow is a request to know what is available that might be tested in order that the defence may have some input into how those matters are pursued,” he said.

“We will have to go and see where the exhibits are after all these years.”

Media reports over the years suggest WA Police have never linked the Birnies to Mrs Fulton’s disappearance.
In a brief statement to The West this week Mr Davies added: “We are in earnest that the exhibits from the prosecution of the Birnies will be located and tested for the presence of Mrs Fulton’s DNA and given the age and ill health of Mr Reddington, we are pressing for this to happen.”

Both WA Police and the Office of the Director of Public Prosecutions declined to comment this week.
The stunning revelations about the Birnies and their potential link to Mrs Fulton’s alleged murder are expected to be examined in greater detail at next year’s trial.
