Any workplace has Risk Assessments and statistical Analysis to back up changes to procedures

Do you have a list of accidents and deaths of roadside stops?

Negligence is only a factor if there are previous incidents ignored by employers

we regularly here about pedestrians being killed on Perth's freeway with changing tyres a common one.

there was one this week

and ordinary crashes leading to death or serious injury

please remember it is probability X outcome and any outcome resulting in serious injury or death remains in the high risk outcome

Hush, hush. Workplace negligence is never talked about if it involves the government... especially Port Arthur.

Best shut the freeways down. Looks like they are dangerous places

But lets go back to your police response. How many police have been killed on freeway stops?

The end point of your criminal negligence means police cant do their jobs - now given your previous posting on this - I'd suggest you would welcome this.

Lets change the Victorian scenario a little. Constables Silk and Miller stop Pusey and he pulls a gun out and kills them. Are VicPol criminally negligent for their deaths? of course not

I have presented evidence to support deaths on freeways is not a rare occurrence AND more importantly the outcome of serious injury or death is the outcome. In short they are dangerous places and this by itself should have been the trigger under the current work place laws to implement mitigation policies and monitor for compliance.

In terms of police dying on freeway stops, the reason why this thread exists....cops have died. Further cops are not super humans and thus the attempts to separate cops from other road users would be laughable in a court, as a reasonable person would simply say "but your cop is dead". A study in the US highlights the concerns https://www.mphindustries.com/wp-co.../Officer-injuries-due-to-passing-vehicles.pdf

It is rubbish to say a cop can't do their job. Rather they simply have to do their job differently, with consideration to safety. I have presented basic and common sense safety processes which would have saved four cops lives. If the minister for police, the commissioner for police and senior management couldn't identify these safety processes, then the criminal repercussions should result. Or should ordinary workers die simply because senior management see workers as cannon fodder?

If pusey shot the cops, then we would like any incident review the events leading up to the shooting. ie were the cops trained, were processes and procedures followed, were the processes and procedures reasonable in light of the risk and were the process and procedures monitored for compliance. This is the recipe of the laws in place. Either we all adhere to them or we repeal the laws.

Pusey has contravened a court order and is on the run.

sounds like it was simply the wrong charge and not appropriate for the situation

what I find interesting is so much attention was provided to pusey and his horrible act but the attention should have been

1) charge the driver of the truck for manslaughter or negligent driving causing death
2) charge the trucking magnate for criminal negligence
3) charge the police management for criminal negligence (instructing police to pull people over on a freeway)
I'm late to your comment, but I was thinking about this.

I think one reason is that culpable driving, even to the point of causing death, is at least understandable. Many people could see how even a generally 'good' person might have a moment of stupidity or terrible judgement that could lead to that. Depending on circumstances, maybe some people might even see themselves in that position. "Gee remember that time I drove home from that party drunk/high, remember when I drove 14 hours straight and was falling asleep over the wheel at the end, remember the time I got in my car when I was so angry....farking hell, I could easily have killed someone that day!".....

But filming dying people while taunting and mocking them, and refusing to render any assistance....that's just so beyond what many people would think as understandable, and we could almost never think of any circumstances in which we'd do that. Like how utterly evil do you have to be to do something like this??
