Mysterious bottle from Mexico sets off alarm - Baker and McKenzie

I have said throughout that not one Essendon player will be suspended.

Every foamer on here (you included I believe) was talking up ridiculous bans. Now you all look stupid.

But carry on.
ASADA only issue ADRV's at the completion of an investigation. The investigation is ongoing. AFL act on ADRV's from ASADA.

Who looks stupid?

Daytripper,

Have they ? Is that in writing ? Or is it just crap that EFC people repeat to each other ?
The AFL have it in writing. Andrew Dillon mentioned it the other night.

Take it up with them IanW.

As I said, qualified google lawyers are hard to find so I'm sure they will appreciate your input.

There cannot be an infraction notices handed out until the investigation and report are complete. Privacy laws dictate that ASADA cannot name specific players in an interim report therefore they cannot pass the info on to the relevant body that would issue infraction notices. It is not that hard to comprehend.

The fact players are playing this weekend says otherwise. The AFL say otherwise.

This isn't hard to work out - surely.

Did you miss the part about it being an interim report and no names listed?

Oh, gosh. Andrew Dillon said that. My beating heart.

And that matched against WADA specifically saying it's banned.

And someone else, possibly Andrew Dillion saying "The AFL notes that the investigation into Essendon’s 2011/2012 supplements program by ASADA and the AFL remains open and could lead to further charges under AFL Rules against other individuals."

You do know that AOD-9604 is only one of the banned, not legal in Australia, experimental, or not suitable for use on humans drugs that Essendon Football Club decided to use on it's players ? And that the current set of charges *arent* under the AFL Anti-Doping Code ? And that therefore those - including those related to the acute lack of written records - can and will follow.

Don't think this issue has anything to do with Essendon players being banned. More the Essendon administration's inability to specifiy what they had their players injected with. Which is astonishing enough in itself.

So basically, the people that run this clinic saw that some old bloke left his drugs on the table and thought to themselves "hmm, I know - let's break the law, inject this foreign substance that doesn't belong to us, that we don't know exactly whats in it, or whether it has any benefits to healthy people at all, into the bodies of professional sportsmen without their knowledge or consent".

Right.

Exactly. It's not believable. Much more believable that the guy who bought the drugs, bought them with the intention of bringing them to the shonky clinic. Dank and his quack associate put the order in, and someone delivered.

I used to think Lance was as Essendon biased as a poster can get but he has actually been very fair and logical on this subject. Daytripper goes beyond what I originally fathomed.

I think Lance had an epiphany a few days ago. And yes, he has been quite reasonable lately.

Hey guys a mysterious bottle of some substance has landed on my door what should I do with it?

A) Inject it into my blood stream
B) Claim it was just some sugar from Mexico
C) I am shocked to be here injecting it
D) Have nothing to do with it?

I'd say it was Danks
According to Robinson, Hird asked him for someone with expertise in supplements and Robinson said Dank. And the three who interviewed Dank was Hird, Corcoran and Robinson. Hird was the one who wrote the memo, clearly placing himself in charge of the program. It was Hird the players went to voice their concerns about the program. Hird, Hird, Hird.

I think he was fairly central to it. :D

How much would you like to bet that not one Essendon player will be suspended?

If Hird goes down (whether its kicking and screaming or not) then maybe you are right.

I'd suggest that there will continue to be a 'lack of evidence' if ASADA feels a strong enough message has been sent to preserve their authority.

If not, I'd suggest the players are in trouble.

TB4 is a banned substance Ian. Not sure what your point is there.
AOD is approved. No Essendon players given infractions so you need to take that point up with the ASADA lawyers, I'm sure they will be most impressed with your google degree.

I'm not an Essendon player so I cannot answer on behalf of them. Tim Watson has said recently that the players and parents were comfortable with what they were given. Take that as you will.

Not sure how you're qualified to answer that question - can you please explain,. Do you have thources like Caro?

lol, learn about how the ASADA process works.

http://www.asada.gov.au/rules_and_violations/process.html

when the investigation is completed, ASADA compiles all the evidence and information and passes it along to the ADRV (anti-doping rule violation panel), a body that's independent from ASADA, who then decides whether a player has possibly committed a violation and enters them into the register of findings (ROF). ONLY when a player has been entered into the ROF can they be issued with an infraction notice.

considering the ASADA investigation is ongoing and they haven't yet reached a point where the evidence has even been presented to the ADRV... there is absolutely no chance that any player would be entered into the ROF or issued with an infraction notice at this point.

that information will ONLY be passed onto the AFL when the investigation has been concluded.

sure essendon may be taking the field this weekend, but they're playing on borrowed time.

These Essendon supporters have no idea about the process nor the legal restrictions surrounding an interim report.

The interim report was a concession to the AFL to allow them go and do what they needed to do before seasons end. They have pretty much left building in terms of any further participation with ASADA now. ASADA are now left to their confidential sources to try and take the investigation from a mass use of PEDs or non approved substances to a more refined level of who took what. The AFL was never going to be allowed to be involved in this part of the investigation because it had no statutory authority to be involved in this level information gathering and techniques used to gather it.

Coenzyme q -10 which is what was in the 'mysterious bottle" is a common WADA compliant supplement. This is yet another beat-up. Mystery mystery, scandal scandal, outrage, outrage......
Those who want to be objective in this matter will bear in mind that no Essendon player tested positive to banned drugs throughout last year's regular testing and that no allegation that players took masking agents have been made.

Is that what it says on the label, or what it actually is. ;)

how come you know what the substance is but essendon don't? the "outrage, outrage" isn't about whether it's banned or not, it's about organisational incompetence.

also not testing positive doesn't really say much considering the drugs being taken.

Am I the only one starting to think they're making these stories up as they go along? I actually laughed when I saw this headline. We have officially entered the theater of the absurd.

*reaches for popcorn*
