The onus is on the Prosecution to link the evidence that the accused was there and the victim's death was at his hands with an intent to kill or with intent to cause grievous bodikly harm.
What do you think about reckless murder here? That was my running theory until his plea. I’m now thinking they want manslaughter as an alternative. Because both sides have reported heaps of CCTV, I’m curious if POS and SM’s interaction will be circumstantially evidenced. If that’s the case, I’m also wondering if the primary angle will be to refute his interaction with/involvement in SM’s death entirely

In the Ballarat Magistrates’ Court in September, the accused man’s lawyers said they’d received the brief of evidence against Mr Stephenson, describing it as “unprecedented in size”.
Without having followed closely, it feels like going to try and overwhelm with evidence as most of it is going to be circumstantial, and lacking a direct link.

Time will tell.
 
Imagine they will have an offer on the table to reduce the charge/sentence if give up body. He’s probably holding out to see if there’s enough other evidence to sink him before he pulls that card.
At this stage i doubt that this is even being discussed by either side; the accused is not going to even give a hint that he could have been in the remote vicinity at the time of her death and the Crown have charged him with Murder and not any lesser charge

To the best of my knowledge, Victoria doesn't have "no body, no parole" legislation. If he does go down on the charge, the Sentencing Judge may take this into consideration in imposing subseqent sentence.

As the Defence chose not to go to commital it's going to be a winner takes all scenario

That seems pretty ridiculous tactic by his defense if true. For the charges to have been laid the coppers surely must have compelling evidence that POS was in the area at the time SM disappeared.

I don't think they will debate that he was in the area (if that's what the evidence shows), but the Crown then has to prove beyond a reasonable doubt that he actually killed her.

Going to be hard to do without direct evidence tying him to her.
