Current Trial Toyah Cordingley * Murder trial of Rajwinder Singh ends in hung jury

Singh told the undercover policeman,
“It happened in front of me and I ran for my life.” Cairns blog.
There’s no evidence of a ‘lanky killer’ on the beach. Singh from his own account was there at the scene.

Since I was thinking about where her phone was taken when it left the beach, that was real shifty. He drove around, past his house and went to two waterways where it might be presumed the phone was thrown in to one of them. So he's taken them on a bit of a wild goose chase.

Not by a jury of his peers

He'd have to be charged first but it isn't just him, the police would be looking to charge the person he was with that day as well.

It's so unlikely they were involved.

If I was to accept Singh wasn't involved which I don't for now, but for arguments sake, I'd be looking at that random nudist who was on the beach and whose dna may also possibly have been found on Toyah's body, over the BF.

More than a few possible suspects. I've heard that the hairs found in Toyah's hand that police never bothered to DNA test were not preserved. Surely that can't be true!

So from reading Cairns Post blog, light brown hairs found in TCs hand were not DNA tested because they were "visually determined" to belong to TC who had blonde hair? Not sure if I am understanding this correctly
The above reference is still there in the 12th March Cairns Post Trial blog. (see screenshot below)

Yet the articles in the Cairns Post 13th March digital paper edition (reporting on the 12th March trial day) omit anything about these hairs. Suggesting that an editorial decision was made to not report this evidence and cross examination of Sergeant Hall about it (in the next days paper).

I haven’t read this.
No I don't have a source. Only a couple of comments I have seen in social media so I don't know if they are right or not. I hope it's not true because police have a duty to preserve evidence.

Media reporting on this trial has surprised me.

Media reporting on this trial has surprised me.
If the trial was in a capital city, and the death occurred in a Capital City metro area, it would likely have had a larger media presence attending it, and more publicity.

Even AAP that some of the main stream media outlets rely on for their trial info, did not appear to have a crime reporter at the trial every day (from the number of trial days when AAP articles did not appear ) directly or indirectly in the media.

Media resources/budgets are stretched pretty thin nowadays.
And this is probably only get to get worse.

I hope they do still have it because if there’s been questions about it in court, and there’s another trial, it might be worth DNA testing to prove who’s it is. I don’t know how accurate what they did with the hair to conclude it was Toyahs, is.

Sounded to me like they looked at it and it wasn't obviously Indian hair so they deemed it irrelevant.

There appears to be some posters that would rather see someone convicted where there is reasonable doubt to appease the victims family. Don’t get me wrong, my heart is breaking for TC’s family but there is absolutely no way any jury or judge could find Singh guilty beyond all reasonable doubt based on the information we know publicly right now.

Does more information become available before the next trial, relevant to Singh or other parties? Hopefully. All of us want TC’s family to get justice, but it needs to be the correct justice.

Craffles you’re right, need to let justice take its course.
I just hope whoever is responsible doesn’t get away with this (whoever that might be.)
Toyah’s family haven’t just suffered the loss of Toyah but been given false hope, million dollar rewards, extraditions, years of waiting for some answers and they deserve answers and justice.
This is a unique case, a person’s been charged and yet say they witnessed the crime.
Maybe if Singh gets out he can give more detail about the killer/s like the clothes they were wearing that day. Police probably know what other people were wearing that day. He doesn’t have to say anything, but maybe he can put himself in the shoes of the family for a minute and then run away.

It’s awful for her family and I really do hope there’s an outcome soon. The police definitely need to do some more thorough work. As awful as I feel typing this, I think it’s going to be a long time, if ever someone is found guilty…..

A couple of interesting facts in the newspapers this morning (Cairns Post):
Justice Henry said he would not preside over a September trial, as he was not available at that time, but another visiting judge may be able to sit in Cairns for a trial if there was budget and availability within the judiciary.
They did not discuss the prospect of a judge-alone trial, which is allowable under Queensland legislation, on application to the court by the prosecutor or the accused person.

I wonder if they put any resources at all, into Singh's claim of witnessing the attack, or just dismissed it outright?

Undercover officer was sent into the prison. So they did try to find out what the only potential witness to the murder knew and whether he could ID the killers.

If critical forensic evidence was not preserved and Singh is the only witness to a murder.... Shouldn't he be in witness protection at this point?

Judging by media reports the second attempt by defence to use Saul Holt KC as counsel in this case was thwarted by the judge and the prosecutor. Re trial was listed on a date not convenient to the KC.

Terrifying that in the state of Queensland you can be diddled out of using your choice of lawyer for the sake of… I’m not sure what.

I wonder if this will foster further public sympathy for the accused after the huge trainwreck that was the prosecutor’s first go-around.

So it now appears that Singh has to find new legal representation that can represent him in starting November 10th, 2025 re-trial.

I wonder if a bail application will be made in the next few weeks or after Singh gets some new legal representation, seeing as how no application was made today.

Otherwise the case is listed again for 19th June re a jury review.

'New date for Toyah Cordingley murder trial set'

'March 26, 2025 - 3:01PM
...
The case will be reviewed on June 19 so that Crown Prosecutor, Nathan Crane, and Mr Singh’s defence can raise any issues about jury selection.

Mr Singh did not appear in person or by videolink and no application was made for bail.
