The accused was in court today.
Next court appearance 17 December 2022.

Hopefully there are not another 99 to go, like with Indian man Puneet Puneet for a 2008 hit-and-run death in Victoria that has taken almost a decade, and for which the accused was granted bail earlier this year to care for his parents.

There is a difference though Puneet is not an Australian citizen but Singh is. That might speed up the process unlike Puneet's debarkle.

Singh probably has dual Citizenship India/Australia.

Toyah's clothes had been removed, I think it's safe to assume there was a sexual element in the attack.

The use of the word "if" in the Dec 2018 article, leaves a question-mark on whether any removal of Toyah's clothes (can't find a source of this clothes bit yet), was the sole basis for what Detective Senior Sergeant Ed Kinbacher is quoted as saying in the below.

'The man suspected of brutally murdering Toyah Cordingley on an isolated Far North Queensland beach has indicated he wants to return to Australia to fight his case.

Rajwinder Singh made his third appearance in New Delhi’s Patiala House Court on Christmas Eve in relation to his extradition hearing.

During his brief appearance on Saturday, Singh expressed his desire to return to Australia and contest the case against him.
“I am ready to go to Australia and face the trial there,” he responded to Judge Nabeela Wali on being asked if he wanted to go back.

Rajwinder Singh was not represented by any lawyer, so Judge Wali granted a Legal Aid Counsel to help him in the case.
“I cannot record your statement as you don’t have a legal counsel,” Judge Wali told Singh.
“I am giving you one, legal aid, who will help you in this case.”
Judge Wali ordered Singh reappear in court on January 7 where his “willingness statement” would be recorded in the presence of his legal counsel.

Two killers and two victims (says the accused).

I envisage that the accused will claim that he was the 2nd victim (Toyah the 1st).

I wonder if the accused is going to claim that a 2nd dog was involved.
Possibly that a dog attacked Toyah. (A wild speculative theory with absolutely no evidence to back it up, other than Singh's reported statement to AAP below in the free article in the West Australain Newspaper today).

Innocent until proven guilty.

He'll probably claim something like that he was threatened by the killer(s) to never tell anyone what happened, and to immediately go back to where he came from (India) and hide, or he'd be hunted down and silenced and his family threatened too.

DNA will be very important if he insists but hopefully he'll change his mind and plead guilty sparing the family a trial.

Maybe the accused is just saying what he is saying to protect his family in India and Australia, and plans to suicide in India or Australia, before the case gets to trial. Hoping that in avoiding a trial (or pleading guilty), his family and their family and friends, will be left with the belief that he is, or is probably/possibly innocent of the crimes he is charged with, and that he is just a victim.

Might India's Ministry of External Affairs find some way or reason to oppose the extradition, in an attempt to avoid embarrassing either the Indian Government or the Australian Government, for if they are either
  • concerned that the accused is innocent and will make Australian authorities look foolish
  • concerned that if a trial goes ahead, it could portray Indians and India in a bad light ???

'... Former Queensland nurse Rajwinder Singh made his first official statement to the Delhi District Court on Tuesday, saying he wants to be extradited as soon as possible to contest the charge.

Mr Singh appeared in court on Tuesday with a legal aid lawyer and made his statement in the dock appearing calm and asking lawyers about the process he was facing.

The judge will now consider Mr Singh's statement and if she approves his extradition, the application will be passed up to the Indian government.
India's Ministry of External Affairs will then make a decision on the extradition.

The ABC understands if that is approved, Mr Singh could go to Australia within the month and at the latest by the end of February.

Mr Singh's decision to consent to the extradition is a big win for Australian authorities who want him to face trial at the earliest possible date.

If he opposed the extradition, the case could have taken years to resolve in India's justice system which had more than 50 million pending cases in 2022.
Mr Singh is an Australian citizen of Indian origin and his wife and three children are living in Australia

Another week (at least) before we know whether the Indian Government will allow the accused to be extradited back to Australia.

An Indian court was due to make a decision on Friday on whether Rajwinder Singh will be extradited to Australia to face a Queensland court.
The matter has now been adjourned until January 20.'
 
Singh appears to now be over Australian waters. (QF70 I presume).
Landing approx. 12:28pm in Melbourne.

'Rajwinder Singh, 38, boarded a Qantas flight from New Delhi to Melbourne on Tuesday evening.
Escorted by seven police officers, he was taken from South Asia's largest jail, Delhi's Tihar Prison, to the airport where he checked into the flight.'
