The man was charged in August last year with two counts of rape, along with one count of sexual assault and one count of attempted rape.

The alleged offences are said to have occurred in March 2023. He has pleaded not guilty to the four charges, which relate to one complainant.

He has been committed to stand trial.

The ABC can now reveal Mr Lister had also been found not guilty of a drug supply charge following a second trial, after police found a drug stash in his Darlinghurst home in March 2020.

A black box stuck with magnets inside an open fireplace contained 1.8 grams of lysergide, or liquid LSD, along with ketamine, methamphetamine, cannabis and MDMA.

The separate jury in that trial heard the LSD, in a small dropper bottle, was enough to make about 9,000 tabs of acid and saw messages where the artist discussed doing drugs with several friends.

When Mr Lister gave evidence in his own defence, he said the bottle belonged to a drug dealer friend who died in late 2019, that he never used it, and assumed it was cannabis oil.

Mr Scully said jurors had to be satisfied he knew the contents was acid.

The verdicts on Friday, October 25 came after the jury sent a note to Judge Jane Culver saying they had reached a "severe impasse" on some charges and further progress seemed "impossible" — even with the option of returning a majority 11-to-1 verdict.

The judge discharged the panel without reaching a decision on all charges, which means Mr Lister is expected to face a retrial next October on the five charges which remain unresolved.
