Why arrest him this weekend when he’s in Perth? Victoria would have handed him over to the Western Australian authorities without a second thought and Richmond wouldn’t have stood in their way. I’m not saying he didn’t do it either, but something is weird here. I mean Western Australian cops definitely knew where he was, he wasn’t hiding.

In a statement to AFL.com.au, Pickett's manager Anthony Van Der Wielen said his client would defend himself and urged the public to respect the presumption of innocence.

"In response to the allegations, Marlion has a strong intent to defend himself against the charges," Van Der Wielen said.




"Due to the ongoing legal nature of the proceedings, Marlion, or myself will not be able to provide any further details, comment or clarification about the matter at this stage.

"We understand and respect the public's interest in this matter, but we also implore all to respect the presumption of innocence until proven otherwise, and to allow the legal proceedings to follow their due course without prejudice."

I'm struggling to see how it's only just came out and why charges weren't laid earlier.

Agree mate, I’m definitely no legal expert but it all just seems kind of odd

Maybe the allegations are minor enough not to worry about putting out a warrant and just waiting until he was back in WA? Or something like that

I guess we will just need to wait and see how it all plays out

Maybe Something has gone down in last 24 hours where someone’s claimed Marlion was a part of these crimes . They arrest and charge him , then try to find evidence if any exists before the bail hearing .
If they only have someone’s word he will likely get bail which I assume would make it easier to extradite him if they find anything in future.

Maybe they needed him to actually be arrested and interviewed before they could charge him?
 
You can generally only arrest a person in WA where you suspect they have committed a 'serious' offence, punishable by more han a year in prison. Burglary is such. There is no power to arrest for the purpose of interview because you cannnot have consideration for bail delayed for anything other than lawfully authorised procedures such as obtaining identifying particulars (ie ... such as DNA) etc. A serious offence permits you take take someones idenitfying particulars. (DNA, Fingerprints etc).

Hypothetical .... You commit a serious and leave a little piece of yourself (DNA) behind at the scene. Exhibits and evidence is gathered for forensic analysis and bingo, a match in the data base, because you have had your particulars taken before (fingerprints, DNA etc) the Police have sufficient grounds, on that basis alone to arrest you. Of course there could be other evidence. As they cannot use your previously obtained fingerprints and DNA in any subsequent new court process (because it is evidence of prior mnisconduct and generally highly inadmissable) they take your idenifying particulars again, ie. DNA, photo, finferprints etc.

Interview wise, if, after you have been cautioned, received legal advice etc. you choose to partake in an interview of your own free will then all well and good but there is no power to arrest solely on the basis of, 'oh well we might arrest him and see if he wants to do an interview and cough'. There has to be grounds for an arrest in the first instance and it simply can't be reliant on a fishing expedition.

Nothing odd in the time between the alleged offences and arrest. Backlog of exhibits for forensic analysis exist and are categorised for prioity based on the nature of offence.

Lastly, why would WA Police go to the expense of an extradition process when they cold reasonably suspect the person would soon be back in WA and be arrested then? Sending two Detectives on a piss drinking mission to Melbourne to apply for an extradition. Na, I don't want my taxes wasted like that.

Remember, everyone is entitled to the presumption of innocence. I have no idea what the 'evidence' is, just posting this to address some of the 'hypothetical's and what if's' posted above about 'how this seems odd etc'. Nothing odd at all.
