I feel this hinges on successfully arguing against carelessness.

1. Maynard affected a realistic smother attempt.
2. It is rare that this sort of collision happens, thus Maynard is not expecting the end result.
3. Once airborne there is no time to react to an unexpected situation.
AFL actually stated it’s a rare thing. I’m saying that they’ve also shown Maynard could not have anticipated the contact.

Didn't N. Riewoldt and J Brown take 2 mark of the year winners running back with the flight of the ball, leaping to mark it on their chest and all the while opponents were rushing at them from the opposite direction?

That could have ended in a similar outcome.

I don't really see the distinction between leaping in desperation to smother a ball and leaping with a desire to mark it.

It was a footy act and an accident.

That was in ancient times. We may need an archaeologist to uncover the facts.

This is precisely why they referred it. They want these matters tested at a tribunal so that when Brayshaw is 50 and attempts to take the AFL to court for inaction on head trauma they can point to this as taking it seriously.
Will this style hold up in future cases?

When another player gets injured the same way can they argue the AFL had the opportunity to change the rules and didn’t?

yes this deals with
  • prudent /reasonable act
  • reasonably foreseeable
  • ability to avoid

although they are still going to circle back around to you should have smothered only with vertical jump ..

And it's perfectly understandable why the new person in the role, ie Laura Kane sent this to the Tribunal. As long as Bruz is cleared, I have no problem with that. Apart from the angst it's caused all of us 😩
