Well, probably because you clearly don't know shit about the process?

Infractions can't be issued until recommended by the ADRVP and even then, they aren't issued by ASADA they are issued by the afl.

So you got pretty much everything wrong

Oh and FYI - the AFL issues the infraction notices on ASADA orders. But you know, you're the self proclaimed expert and everything :rolleyes:. But the point I'm trying to make is the show causes notices should have been issued months ago, EFC players should have well and truly responded by now, the ADRVP should have given the go-ahead, ASADA should have ordered the AFL to issues the infraction notices and the 'tribunal' should have given the players bans by now.

You've got all the evidence they need to give the players bans. I don't see why they haven't issued the infraction notices yet quite frankly.
Because they can only issue infraction notices after the end of the show cause deadline
 
I can't see an essendon victory, regardless of the decision
Nor can Essendon, that's why they're going for the all encompassing injunction.

Doing it this way so that EFC cannot claim later on that they weren't provided natural justice
 
They can still have standing to bring a lawsuit, as has been explained both in the media and on this board by non-essendon legal people.

Standing, yes. But courts are very reluctant to make findings where the people that will be affected are not parties to the action. Case law is on ASADA's side about the need to have the players part of the action.
 
If Essendon, and Hird, win and life at Windy Hill just carries on as if nothing ever happened, and Jimmy waltzes back in all smug and self satisfied, all this without "the TRUTH" that Essendon and Hird were so desperate to put out there being heard, and only achieved by obfuscation, legal wizardry and without the players ever finding out what was put in their bodies, then how do Essendon and non-Essendon people think Essendon will be viewed as a club.
Personally, I would feel nothing but contempt for them and they will never win any respect back.

Have had a look at some of the tweets by Hardie. Seems very 'cocky' & sure of himself.

With most academics, you have to question why they aren't working in the private sector. I personally know the top rated lawyer in Martin's field (he is a partner & is the lawyer for one of the major papers) & the general conclusion of Hardie is he is a nutter who can't get a job in the private sector.
 
It is foolish for any lawyer to make predictions about a court case where he does not have access to all the facts, especially a teaching lawyer.

Why are we going to trial if theres no case to answer?
To test the argument.

In reality though, it's all about trying to protect Hird and a last roll of the dice for Essendon to stop being sued once players are banned.
