Maybe the first ever case in Australia of someone being found not guilty of child sex offences because they were probably suffering from a sleep disorder called 'sexsomnia'. (otherwise know as parasomnia). See today's DM article far below.

Interestingly, there's a UK case (victim McCrossen-Nethercott) where the Crown Prosecution (CPS) claimed that the victim could have had an episode of a rare sleep condition called sexsomnia, after waking up to discover she was half-naked, and with the sense that she had been r*ped while she slept.

Based on this, the UK CPS dropped the women's rape case before the scheduled trial, and the defendant was acquitted.

Then In 2022, McCrossen-Nethercott sued the CPS after it admitted her rape case should not have been dropped, and the CPS paid her compensation of £35,000, “apologised unreservedly” to her for dropping it like they did.

'I accept such observations were made by multiple friends with whom the accused had countless sleepovers with over many years,' the judge said.

The judge also pointed to the psychiatrist's conclusion that 'the complainants' statements strongly suggested that the accused was asleep when the offences occurred'.'

Criminal elements still influential in CFMEU construction division, report finds​

A report commissioned by CFMEU leadership and carried out by respected barrister Geoffrey Watson SC has found bikies were still influential within the union and that EBA negotiations had become "vulnerable to corruption".

"On the information available to me, I consider that the Victorian branch has been infiltrated by OMCGs [outlaw motorcycle gangs] and by organised crime figures," Mr Watson said in his report. "The Victorian branch has been caught up in a cycle of lawlessness, where violence was accepted as part of the culture, and threats of violence were a substitute for reasoned negotiations. From my investigation, it appeared to me that, in this cycle of intimidation and violence, the CFMEU had lost control."

Mr Watson said during the course of his investigation, serious threats were made against CFMEU officials who were seen to be co-operating with the investigation. He found union branch officials had not only engaged in threatening and abusive behaviour, they had also been subjected to threats, violence or abuse.

Mr Watson made seven recommendations, including that the CFMEU build co-operative relationships with police to deal with criminal conduct. He also recommended further investigation into links with bikie gangs, a review of EBA processes, and the process by which union delegates are appointed. Mr Watson also recommended an investigation into a specific allegation that union official Derek Christopher received around $200,000 in free labour and supplied from building companies in 2017.

Former BBC presenter Huw Edwards avoids jail over making indecent images of children​

Huw Edwards, the former long-time face of the BBC's flagship news program, was given a suspended sentence at a London court on Monday after admitting to making indecent images of children. Edwards, 63, pleaded guilty in July to three charges of making indecent images of children, relating to 41 illegal images he was sent via WhatsApp — including two pornographic videos of a child aged between seven and nine-years-old.

Judge Paul Goldspring sentenced Edwards to six months in prison suspended for two years, meaning Edwards will not go to jail unless he commits another criminal offence in that time. Seven of the illegal images were of the most serious category, prosecutor Ian Hope said, and both of those videos were marked as "read" on WhatsApp. In response to the second video, Edwards asked the man sending them: "Any more?"

Also, I’m often really tired and cranky. For years I blamed my husbands snoring. At my nagging he did a sleep study and he’s normal, no apnea. Turns out Im the problem. One of the worst days of my life
