It would take either a very brave or reckless woman to make these allegations while still in custody so I'm thinking the victim possibly waited until she was released to make the report.
The 36-year-old man was charged with three counts of aggravated sexual assault and one count of engaging in a relationship with an inmate, causing a safety risk, police said.
He was arrested yesterday morning by detectives from NSW policeās corrective services investigation unit, which set up a strike force to investigate claims a 28-year-old inmate had been sexually assaulted.
The assaults allegedly happened at a correctional centre at Wellington in the stateās central west between 18 June and 30 July, though police did not receive a report until the start of August.
The man was taken to Wellington police station, where he was charged and refused bail to appear at Dubbo local court today.

Why can't this PoS be re-tried? His perjury almost certainly resulted in his acquittal of rape charges. Hell, he should be re-tried merely for having the gall to appeal the length of his perjury sentence!
A key issue in the rape trials was where his dog was living at the time. The nurse claimed that when she tried to leave Kader threw her against a wall and pinned her there. In court, Kader said this would have been impossible because there was a piece of furniture against that wall and his dog's bowl was in the way.
He had told the court the dog was sometimes with him, and at other times with his ex-partner. But that was undone when his former partner gave a statement to police saying the dog was with her all of the time. Kader wrote an email asking his former partner to support his statement.
"We can't agree to that going to the jury because the prosecution will simply argue that the dog had moved, the crate was gone and I have provided an old photo with the dog bowls and dog food to deliberately fill the wall with stuff," Kader said. "It will be obvious that I have lied under oath, my credibility will be gone and I'll be convicted."

So heās 19 now and these offences happened in May, why the hell canāt he be named due to āYouth justice lawsā if he was an adult when they occurred?
Regardless there is obviously no hope of rehabilitation given these offences took place so soon after being released and he needs to be incarcerated indefinitely and file marked never to be released.
