The main difference with this and the Lobster Tears is that they’re using JHF on the can. Giving a reaction like this is only going to fuel the flames though

What would actually be their legal standing on this. If they don't mention JHF or the clubs in any material surely nothing could come of it.
It looks like bully boy tactics from Port as legally in Australia there would be very little recourse.

Given that it is a small brewer it's probably unwanted time and expense to engage lawyers to thwart any threat of legal action.

If legal action was to proceed the filing would no doubt be highly amusing.

What are the parody laws in Australia?
I know in the US as long as no name is used when attached to a likeness, it's fair game (see southpark)
Koshie and Port have less of a sense of humour then Americans.
Oh poor precious port, always the victim, they’ll probably blame vic bias for the actions of a qld brewery..

Pretty good summary here - What you need to consider before using a celebrity in your product

I think this would be most relevant in this case.
"However, it is good to note that just because you used a celeb’s image without their permission, this does not mean that they can successfully sue you. The famous person must clearly prove that how you have used their image could lead your customers to think that they are associated with your brand. In some cases it might be really easy to draw the connection, and in others, you might be able to fight it."

To me it stinks of bully boy tactics from Port and the main reason the brewer buckled is probably because wouldn't it's worth the time/expense for a small business to engage lawyers to counter any legal action.

No AFL player would want a commercial interest using their image without their permission (or payment)

We have seen much worse examples than this, like Taylor Walker suing a burger joint for having a "Tex" burger.

So Port are the bullies here? Not the ones taking the piss and trying to make money out of a 19 year old
Thanks again for reminding me how old jason is, his bday is going to be epic.

I'd assume there is probably some kind of licensing agreement that the beer producer breached which has led to the legal action.

But I will admit I found it hilarious.

Even if they settle and remove the product, they've just picked up a truckload of free advertising.

When did this happen?

Several years ago. The venue was on King William St in the CBD and was less about the name Tex and more about the accompanying text that referenced Walker and his burger preferences.

It’s a caricature with no name reference at all.
Lighten up

But the small brewery didn’t use the names, number or current team colours.
Totally different I can’t believe ports stance.
Even dolph had a laugh at lobster tears.
