Now I think there is evidence to back this up, there is also, I conceded evidence to suggest that cannabis could be used to treat schizophrenia, but before you hit out with your holier than thou sentiment consider that:

Now I acknowledge that the research can be hard to interpret, but I think the above speaks volumes and backs up what I have said.

Well, I think what a magistrate thinks about it is obvious. If Carlisle was found in possession of a few grams of cocaine he would likely get a suspended sentence or a fine and a spent conviction. Newman got a year in jail. Surely it is obvious that Newman's crime is far worse than Carlisle's in the eyes of a magistrate? I'm not saying Carlisle didn't commit an offence, however his offence was lower on the scale than driving while drunk IMO, let alone assaulting someone. It's more of a health issue than a criminal issue and should (and would) be treated as such.

Moving away from just Newman, if you compare the average sentences for people committing assault to the average sentences for simple possession, you will find those committing assault go to jail for a lot longer.
I would be interested to see some evidence for your point that the judiciary sends aboriginals with similar records who commit similar crimes as white people away for longer. We all know far too many aboriginal people are in jail, but that is because far too many of them commit crimes, are shit at hiding them, have existing records and have little positive going in their lives to justify leniency.
This is very true. Also the case with poor white bogans too that I have seen in the system. However, much more likely to be an issue with indigenous people. The free lawyers aren't much chop compared to a John Prior or similar.The major difference With Indigineous incarcerations is being able to afford a top lawyer or to even understand your rights Or get good advise with what to say or not to say in any police statements .I don't know this as fact but just a casual observation Which I imagine that a lot of Indigineous prisoners with poor education or advice and no real understanding of how the court process works .
To use it as a excuse in Newman's case is Imo wrong .

You admit to being a lawyer?As a WA admitted lawyer, I am interested in where you have found the evidence that aboriginal people on average, get heavy sentences for the same offences committed than does a white person (or at least I think this is what you are alleging).
You sure you not confusing the higher average rate of incarceration per head of population, which is something entirely different and based on aboriginal people having a greater exposure to the Court system (entirely a different social issues)?
Pretty comfortable saying Newman didn't get the sentence he did because he was of aboriginal extraction. He got it for being a dick and in particular, because it wasn't a spontaneous act of violence!
