For this very reason there is a principle in defamation law that says your reputation can't have been defamed if everyone already thought you were a piece of crap to begin with.

It was different with roberts smith- before the allegations everyone thought he was a golden boy.

Wayne however would be pushing the proverbial up hill trying to argue the casino or any media have defamed him given the mountains of evidence which support a claim that society already thought of him as a scumbag.
Note - irrespective of Carey's past 'misgivings/incidents', he simply has no claim for defamation here unless a 'statement of fact' has been made by Crown and/or the media that; 'the substance was an illicit drug'. Suspicious/alleged/maybe/possibly/believed to be - are all opinions, not/not a statement of fact...

Accordingly the ball is now firmly in Carey's court, in relation to his reputation, public identity and possibly future livelihood, if he can prove this substance was indeed a known legal pharmaceutical? And again, even if he does he has no realistic claim for any further legal recourse...

The best form of defence is attack.
He knows the alleged drugs are no longer so there is no evidence or proof they were illegal.
But as for suing Crown , I have not seen them once say Carey had illegal drugs.
Just makes me think this is a guilty man’s bravado To save face.

Concur, I've also not seen a public statement from Crown saying Carey has been 'banned for two years'..? - 'Reportedly', 'Sources say' etc. is simply media speculation to enhance the story, not confirmed fact..!
And good luck taking Crown to court for so-called 'unlawful discrimination' related to his ejection from the premises. The fact Crown did not contact police almost contradicts this claim...
 
This is my only moral judgement on cocaine - so if we were half smart here, we'd legalise it, tax it and take its distribution out of the hands of criminals.

As for it being a news story, well colour me shocked - ex-AFL player does coke. Who would have thunk it? I am amused at the crushed up anti-inflammatories defence though - that is hilarious. We all carry our prescription medications with us, making sure to crush it up whenever we're out for a big night on the town, don't we?

Have you ever tried to rack an uncracked capsule or whole pill?

  • Offence (we used to say Attack: what was wrong with that?) and DEEfence
  • “Hawthorn Hawks”, “ Carlton Blues” , etc. No, one’s a name and one’s a nickname; you don’t say “Here’s my mate Robert Bob”. Let WCE, SS keep their American names, but leave the traditional clubs out of that crap
  • “Alternate” when you mean “Alternative”; “Lay” when you mean “Lie”
