Firstly, the tracks through those forests are well known as a back-way for people DUI to travel between Ballarat and Mt Clear/ Mt Helen / Buninyong and avoid main roads for part of the way, and therefore avoid police detection.
Are Ballarat Police often out in the same locations on Sunday mornings, stationary or cruising, watching out for suspected and obvious under the influencers?

My first post here, apologies if I'm repeating anything that's already been said.

I'm a Ballarat local.

Firstly, the tracks through those forests are well known as a back-way for people DUI to travel between Ballarat and Mt Clear/ Mt Helen / Buninyong and avoid main roads for part of the way, and therefore avoid police detection.

Secondly, a murder charge can result from "a reckless indifference to human life". For example, deliberately removing and not rendering assistance to a person who, theoretically, had been hit by a car..
You are spot on re the back roads that way, i know them very well... and if you are over the limit and heading buninyong way, thats the way to go to avoid the two main roads
 
I thought hit and run was ruled out?
It was 🙄. They’ve examined his car/ute. On the outside anyway. There is usually damage if you hit someone hard enough to cause serious injury or death.

I might be wrong but I thought they've said, in summary,
  • we are alleging this was a deliberate act, ie murder
  • not a hit and run


latest HS article (updated 26 miutes ago) still says

"The Herald Sun understands detectives are exploring whether Ms Murphy was struck by a car after she left her family’s Eureka St home."
 
Maybe Sam Murphy saw an under the influence driver run off the track/road, or driving erratically, and Sam started taking videos or photos of the car and driver.

With the the accused then not too happy about this, and an altercation occurring between them shortly thereafter. Possibly using his vehicle as a weapon.
 
Geezus… a bender, ffs. Is it possible he can’t actually even remember where he took her? If he drove her into a non-mobile coverage area there’d be no way to triangulate the right spot. I feel so sad for Samantha’s family. This must be all the harder for Mick to hear this stuff on his birthday of all days too. I really hope they can find her, and at least give the family a chance to bury her and have a place they can go to grieve.
 
Maybe the police seized the car to find any DNA belonging to her, if he stored her in the back and transported her. Just because they seized the car doesn't mean he hit her with it. Usually standard practice when someone hides a body, they check the vehicle for DNA.

With all due respect, I don't think the police would play silly word games when making official statements to the press following developments like this in high profile cases. I just don't see the police categorically ruling out a hit and run if this H-S report is accurate.

Yes, you could say that technically it isn't a hit and run given a certain set of circumstances, but to completely rule out a hit and run when he could have easily just said he couldn't comment on that aspect of the investigation, it's just a red herring and it doesn't serve anyone any purpose. They've charged a suspect, people are satisfied.

The police representative is in complete control of these press conferences. They answer the questions they can, they flatly refuse to answer the ones that they can't and the press respects those answers and non-answers.
 
A link has been established between missing mother Samantha Murphy and her alleged killer.

The mother-of-three worked in the uniform shop of St Francis Xavier Primary School as a volunteer.
Her accused murderer, Patrick Orren Stephenson, attended the school as a child while Ms Murphy also worked there, 7Newsreports.

Police had previously stated that Ms Murphy and Mr Stephenson had never met despite living nearby.
Mr Stephenson is a similar age to Ms Murphy’s oldest child, daughter Jess
 
I think it is clear this was not a hit and run, not a hit accidentally, the cops have been very clear this was no accident, and the murder charge supports that. ie: not dangerous driving, not manslaughter, has been CHARGED with MURDER. That says a lot, they have the evidence that they believe has a reasonable chance of proving it was murder. and was likely a premeditated act that ended in murder. Highly unusual without a body or confession. They definitely have a LOT of evidence. this is no drunken accident that resulted in getting rid of a body. IMO this is much more sinister. Time will tell.
