Besides tests can't find TB4
Armstrong was probably tested 10000 times and never tested positive, its a myth that the tests actually matter its paper trails and people talking that prove guilt.

The chemists working on the cheats side are paid to stay 1 step ahead of the drug testers and they always will.
So there is no way to prove innocence then
 
I wouldn't be surprised if there will be at least one player to accept guilt and spill the beans. I think it would be one of Crameri, Monfries or Gumbleton. They are no longer with Essendon and figure they can get a big pay day if they just accept it and sue the club.

On the public record it's clear not even Dank knew TB4 was banned...

Wasn't his defence going to be that Thymosin B4 shouldn't be on the banned list in the first place. I wouldn't be holding out hope for that to work.

Follow your last two points. All it takes is one player to come out and say 'I was told I was injected, or about to be injected with...... TB4'.

Then, with all the records that show it was purchased, supplied and on the basis of one players admission - injected - then all the players are gone....
 
He missed the initial 2 and then had all results erased. The article only mentioned his higher placed finishes. He may as well have not even been competing that year.

That only hurts if you win a world title. West got to race every race weekend but two. Got off light in the end.
 
I'm wondering what would the remaining 17 club presidents say if Essendon decided to take ASADA and the AFL to court and question the legality of the joined investigation...Chances are it would be something along the lines of what they told Little when he urged them to impose a vote of no confidence in Vlad and AFL last year :)

No player is going to admit guilt if they believe they are innocent which is what Asada wants.

Yeah.
It's fact that Essendon players were injected with something.
There is a lot of evidence that suggests it was TB4 but nothing to indicate anything else.

And he doesn't want to miss two years with Port playing like this.

I don't expect the player to say much. It's more by his actions. It's going to look funny if a few players just accept responsibility and plead guilty while the rest are fighting it out in court saying they didn't take it.

Of course those who are just going to take it would be claiming ignorance. If they admit they knew they were taking a banned substance it would imply complicity and damage any case they want to take against Essendon.
 
You can have contracts and legal documents in Australia using other laws than Australian law. As long as the signatories understand this and then sign the bloody document.
Exactly they signed up to it willingly an as such are now bound by it

Of course there WAS paperwork. If the show cause is backed by lots of documentary evidence pointing towards guilt, then the players would want the club to find any records or other evidence that show an innocent version of events is also possible, ideally probable. "Pinning" implies both innocence and a wish to prosecute based on evidence that is known to be shonky - only the most deluded observer could think it was relevant here.

Slightly different scenario, but understand the angle you are coming from. There is a difference in the clubs saying they support the AFL and that they believe that Essendon should have been under investigation and that the AFL were doing the right thing, and then denying Essendon the right to confront these allegations if they so choose.

The Dons have to be able to challenge, otherwise the system wont stand up in court. Is it going to make it any better - probably not...
 
Ummm... nope... the players have to "show cause" why they shouldn't be placed on the register of findings. If they can't, it goes to the ADRVP where ASADA will have to provide evidence as to why the players should indeed be placed on the register of findings. If they are, the AFL Tribunal then has to weigh up all the evidence and recommendations from the panel to decide what length of bans, if any, should be dished out to the players.
No... ASADA presents their findings to the ADRVP who will then send out the show cause letters to the players. The players then have to respond to the show causes by presenting to the ADRVP why they shouldnt be placed on the register of findings. If they cant prove why they shouldnt be placed on the register, they are then inscribed into the register and an infraction notice is then issued to the relevant sporting body.

WE are already at the ADRVP stage. If the players don't respond within 10 days to the panel, the panel convenes and determines the punishment, enters it into the register of findings and the AFL gets the infraction notice. The AFL anti-doping tribunal convenes and either implements the punishment recommended or abandons that recommendation and implements a finding of their own.

Either way... the Essendon players who have been issued show cause letters have to show cause why they wont be found to have infringed the Australian anti-doping in sports laws and not be entered into the register.
