The probable cause affidavit alone is pretty damning. The evidence we know so far from that is:-
  • A vehicle matching his own is on CCTV arriving prior and leaving at high speed immediately after the murders
  • An eye-witness saw someone matching his description in the house and leaving immediately after the murders (and possibly was able to pick his photo out in a lineup)
  • A KA-BAR sheath to the (likely) murder weapon was discovered under one of the victims bodies with single source male DNA identified on the sheath button clip
  • Garbage taken from his parents residence was tested and identified as the biological father of the suspect DNA profile (excluding 99.9998% of the population)
  • A latent shoe-print was found on the scene (unsure if a matching shoe was discovered or was a size match to Kohberger)
  • His phone activity shows the phone was turned off (or put in flight mode) after leaving his residence before the murders and turned back on during his circuitous drive home
  • His phone activity and CCTV footage shows repeated visits to the vicinity of the house prior to the murders
Since the PCA we know his DNA was a match to the suspect DNA profile from the knife sheath. We also know that his 'alibi' was that he was out for an aimless drive and went to a park to view the stars (on a completely overcast night). There was no explanation for the turning off and turning off of his phone during this drive.

The defense has a difficult task to discredit the states evidence IMO. I too am looking forward to watching the trial, but on face value of the evidence so far, there is very little doubt of guilt in my mind.
Five months ago it is understood the Prosecution hadn't provided defence with the evidence / full disclosure. Defence have since alleged Law Enforcement obtained evidence illegally and BK didn't have his rights read to him.

Defence have also challenged the legalities of Law Enforcement obtaining search warrants of BK's house and vehicle.

Other than the knife sheeth it's all circumstantial. Even the knife sheeth it's possible he sold it to someone else and they used it during the crimes. You would think though with the phone turning off and the sheeth DNA he's probably done it

There is a common misconception that circumstantial evidence is somehow less than direct evidence. You might be surprised that DNA on the knife sheath is also circumstantial evidence.

On it's own, the circumstances of someone's DNA being present at a crime scene is not strong evidence that the person is the perpetrator. However, taken in conjunction with other evidence, such as it's presence on the sheath of the likely murder weapon and there being no other DNA present, it is very strong evidence that the person who matched the DNA profile on the sheath is the perpetrator.

An eye witness account is direct evidence and can often be unreliable, but in conjunction with other circumstantial evidence such as the suspect's phone being tracked to the location in the time frame the eye witnessing took place, increases the weight of that direct evidence.

Evidence is evidence, it is the weight (hence the scales of justice) of that evidence when viewed in totality that determines whether there is, or is not, reasonable doubt.

Give me a murder trial and I will give you a defense claiming they haven't received all the discovery, or they received it late. On occasion it might be true, but it doesn't mean that the late discovery is excluded. It is generally a stalling tactic.

Similarly, the defense will challenge all the evidence by whatever means in an attempt to exclude it. If all the evidence points to your client being the perpetrator and there is no exculpatory evidence (evidence clearing the suspect such as an alibi), there isn't really anything else the defense can do but attempt to exclude as much as possible.

I'm sure they'll attempt to do so.

Is it likely that all of these things happened to occur coincidentally the exact same times in the exact same location that there was a mass murder by someone else? I'd say not.

Can that be proved beyond reasonable doubt is the question.
 
The timeline might actually be that there was another home invasion a year before that Kohberger is being looked at for.


Interesting...was he planning to do it a year before but didn't succeed with his plan?
