By court reporting standards, the post above with all of the tweets in one place is an astonishingly coherent and easy to read record of a case (Although no doubt very intellectually dishonest)

I look forward to a brave new world where the Federal Court Reports are published in 140 character paragraphs.
 
Guilty until proven guilty.......
We already know he's guilty.
That's why we are in court Dave.
So that the next time he's interviewed,he won't say anything that makes him guilty.
So simple to see through this muppet Hird.
Even for simple people like moi.
This case must surely place Hird in the never go full re"""" category simple.

Fair enough criticism but how 'bout the other extreme of Fabulous Phil - players accepting bans but not actually being guilty. I get the feeling some posters will never accept there is guilt on the part of Essendon and it's staff.

I've already stated many times that their is guilt on the part of some club staff. Who and how much is still to be determined IMO.
 
Unfortunately, it's too late for that. Had he cooperated in the early piece, I think most people would have said anyone can make mistakes and in time it would be a distant memory. However, his actions have been that of a man who has many skeletons in the closet and to the non-Essendon supporter in the street he is very much guilty by his actions.
No matter what the outcome of all of this, the football public aren't complete fools as James would like to believe, and many have already decided what his fate should be. Hird should never coach Essendon again, nor should he be involved in football in any other capacity. His reputation will simply be one of someone who stooped to conquer, and he only has himself to blame. How it impacts on his professional life, only time will tell. The business world tends to be much more forgiving than the sporting public.

a lot of business is networking and i think a few people Albert has thrown under a bus will be spreading the Hird Turd Word within corporate world...he's burnt the wrong people

Seems lawyers are the only ones who gain anything from this convoluted legal system.

Powerful point. Howe was unable to point to the necessary power within the Act.
But managed to point to the implied powers, if they are supposed to work with sports organisations one would think that included the use of whatever powers they have.

As admitted by Hank they could have had the AFL ask the questions they wanted them to ask, result would have been the same as asking themselves, even if Hird somehow wins this appeal which is based on different arguments to the first case so it is unlikely, the SCN's will probably still ber valid, so all in all a waste of time.

Well isnt the whole damn system from the courts to parliament set up for lawyers and accountants to make money from, I often wonder if this is how they get their own back for being the bullied nerds at school?
 
These points at the end of the appeal seem to say it all about James hird and his claim to be doing this for the players

  • He did not challenge until “he did not like the outcome”
  • All 34 players want the process to proceed
  • They want to contest it on the merits
  • The Appellant alone is here
and this from day one should give us all an insight into what he really thinks of the players

Hanks on the fact Essendon and the players want to move on: "So what?"

Their thoughts aren't relevant to any relief Hird is seeking

Not sure how many accountants are in the political system, would be a lot more economists, would suit any profession where no two people can agree on anything.
 
How deep are Hirds pockets? Just the initial court case and this appeal would have cost a mint.

He probably would go to the High Court if his lawyer just keeps on telling him what he wants to hear (That he is right).
He put a toorak property up for sale a few months back, so one can imagine it may be starting to bite.

As someone else opined, he 's somewhat "pot committed".
 
I thought the thrust of Middleton's decision was that Essendon et. al. went along with the joint investigation and after a lot of legal counsel on the matter. So, basically, they gave it legitimacy by freely participating in it.

The stuff about Hird's counsel admitting the AFL would be able to ask questions on behalf of ASADA pretty much nails it. I can't see how they can argue that them both being present at the same time was a key problem, especially since they stated publicly that they were all very keen on the idea.
