Yes, I know, a pig just flew past my window too.

The defence seems to be shaping as
- we stuffed up with a few minor details
- we tried to correct it
- have mercy on us

Agreed on the defence tactics, plus a really hard nosed bastard of a QC to try and deflect anything that threatens to derail the above approach.

As for Trigg, I think the AFC are taking zero action against him - at this stage - as a support to that approach. You know - he didn't do anything really bad type of approach.

IMO Trigg's future may well be decided by the AFL rather than the AFC. If we get belted by the AFL, then so will Trigg and he would be very likely to be banned from holding an office anywhere in the AFL if that was the case.

If the reverse holds and by some miracle the AFL treat us likely, then the AFC might do the same to Trigg, on the basis that it was nothing serious and that's how we also see it. Very very unlikely though.
 
Apart from almost proving Galbally to be a 24-carat clown, how does this represent professional conduct?

``In Adelaide?'' Galbally asked cheekily. ``Well the laws and rules are very minimal in Adelaide. People don't understand much over there.

``You've got to understand: we're over here in a much more complicated, complex civilisation over here. We're in Melbourne, Victoria, so things are much more complicated.''

When Tippett was brought up, Galbally thundered on.

``He comes from Queensland, so he's even more backward,'' Galbally said.

So on radio he refuses to say anything because it's before the courts, but he's happy to toss in character assassinations like these?

I hate lawyers because I don't respect anyone who changes their opinion based on who's paying the bills. Crap like this just makes me hate Galbally more than the rest.

When I was deciding what I wanted to be in life I considered, briefly, law. This is why I never became a lawyer:

I said to myself: can I defend someone who I know is guilty? The answer was, no.

I said to myself: can I prosecute someone who I know is innocent? The answer was, no.

These are simple moral questions, most of us on BF would say ‘no’ to both without hesitation.

All parties in this mess have hired guys who would say 'yes' to both without hesitation...It is going to get very, very, ugly.

If you know those things you're not ethically allowed to defend or prosecute someone.

Galbally seems to be misinformed, he believes Kurt is from Queensland when in actual fact he is from NSW, where things can really get complicated.:rolleyes:

Duty to Court and Law trumps Duty to the client :)

As for those saying they can't protect people they know are guilty, or prosecute those they know are innocent... There are other areas of law. Not everything comes down to sending someone to jail.
There's no way I could work in Criminal Law, but am quite happy on the commercial side of things :)

Perhaps only 10% of lawyers have to make those decisions - primarily criminal lawyers. And there are professional conduct rules out there, breach of which can and does result in lawyers being disbarred or deregistered. For instance under the Australian Solicitor's Conduct Rules published by the Law Society of SA, Rule 3.1 states that "A solicitor’s duty to the court and the administration of justice is paramount and prevails to the extent of inconsistency with any other duty."

Rule 19.1 states that "A solicitor must not deceive or knowingly or recklessly mislead the court."
Rule 19.2: "A solicitor must take all necessary steps to correct any misleading statement made by the solicitor to a court as soon as possible after the solicitor becomes aware that the statement was misleading."

What occurs in real life is a lot different to what occurs on TV legal dramas!
 
FFS Kurt Tippett is such a ******* silly! wish he'd grow a ******* conscience, but I guess you'd have to be a semi-decent person for that to happen!
This is not Tippett's fault. It is our fault. We chose our path now we need to finish it.
