WADA to appeal AFL Tribunal's Essendon ruling

Just to correct a fact - it was not behind a fence, it was about a rope barricade and Hird walked by within a metre of me. He definitely heard me ask him "so when are you going to take full responsibility?" I could see it register that he heard and he instantly looked away.

Another Essendon poster (Dan Cooper) stated that Hird always looked everyone in the eye when I know for a fact he doesn't.

And yes I believe Hird is a lying narcissistic sociopath.
So he would of been within his rights to give you a Clarkson clip to the chin before finishing you off with a swift kick Scott style up your clacker. I'm sure you would of puffed your chest and told everyone around you " see me I told him ".

What I don't get is when hird decided to appeal his unanimous court finding he was shot down as desperate and deluded, yet when wada appeal the unanimous verdict they are heroes.

Hird was trying to suppress the truth.

WADA are trying to uncover it.

Most people here want the truth - Does that help explain things?

Can anyone explain to me the prevailing attitude in here that WADA are going to win this appeal? I don't get it. People are acting as though this is now a done deal. Posters who disappeared completely on March 31 reappeared as if by magic, and now it seems to be generally accepted that the result is going to be over-turned. I don't get it, anyone care to explain?

They've all seen the James Hird interview on AFL360!

Wasnt it exactly the same up until the AFL tribunal hearings... 50 million social mediaites all hanging on to a pre formed verdict they talked themselves into...

On march 31,the board seemed to fill up with efc poster's claiming innocence and doing the normal football brag.
Probably the nature of tribal sport's brings out the "you beauty" element.
Thought that was obvious to you.
Maybe you're hoping to hook a fish with your post.
But in true style its nothing but tribal allegiances.

Just want to see the truth. Couldnt care about suspensions. One answer. What drug if any were in all the injections the players recieved. This is ridiculous that noone knows. One answer and the whole thing is over with

I don't. I think what ever happens will happen. But I still don't trust the AFL in all of this.
WADA/CAS at least seem to be independent. If Essendon/the players get past this hurdle, well then I've been a silly sausage all along.

Yeah, on my behalf, it was kinda obvious a week before the AFL Tribunal announcement when McDevitt spoke at Estimates, that he was sorta resigned to the fact AFL Tribunal were likely to let players off and that ASADA wouldn't bother with an appeal and just send it all to WADA.

I wrote as such here on the HTB 30 minutes after his Estimates appearance. To my way of thinking, the time between the AFL Tribunal decision and the WADA appeal has been complete dead air time.

Of course, for EFC'ers it was a beautiful space for a bit of well longed for chest beating.....but it has essentially been dead air time.

Now, as Whately sighed to The Oaf the other night "It suddenly feels like the adults have entered the room Robbo"

Someone on our board referred to WADA as the AFL's 19th Man. I kind of liked that.

Probably because on March 31 we all said "hey, WTF??? That series of decisions does not make sense... Surely they're not judging "comfortable satisfaction" right", then WADA, the group who wrote the rulebook, appealed saying they don't believe the judgement used the correct definition of "comfortable satisfaction".

Notice too, that the flood of posters who appeared on March 31 as if by magic, all screaming that it was over, and there was zero chance of a WADA appeal, whose volume and intensity of posting increased exponentially every day, all disappeared as if by magic yesterday.

belief more than anything.

people are suspicious of anything that has afl fingerprints on it

but I don't think it's a foregone conclusion by any stretch

Everyone went away until further notice
Further notice came
Everyone came back

As for the confidence in WADA, no one expects a guaranteed win, but they don't appeal lightly so they clearly think there's something in the evidence

I have no idea how this will turn and do not think its a done deal.

It will very much depend on on how CAS interprets 'comfortable satisfaction' in relation to the existence of otherwise of TB4.

We have discussed this previously where I put forward the view that the tribunal set the bar too high. ASADA and WADA both seem to share that view. If CAS agree with that ten I think the players are in trouble. If CAS take a similar view to the tribunal then the original verdict will have been confirmed in an environment where nobody can accuse the AFL of covering things up.

....and yes, I went back to my own board to discuss Freo's season as the matter on the HTB was dealt with. Wasn't really anything to discuss prior to WADA lodging the appeal. When the appeal is finalised, with whatever result, I'll disappear from these hallowed halls again in all probability.

The bar of comfortable satisfaction will be lower I believe than at an AFL Tribunal. CAS are traditionally alot tougher in anti-doping cases than local organisations. WADA seem confident too as they don't appeal cases unless they really believe they can win. CAS are more likely to set the bar lower too if there's no records as they'd be most reluctant to set such a precedent. Cycling teams would be right on to that.

Having AOC President John Coates as CAS President doesn't help either. He's stridently anti-doping and anti-AFL in regards to their drug testing. Has had a bit to say on Essendon. While this shouldn't make any difference he's not the one you want as CAS boss. They and WADA do get to select two of the judges, so they'll be from overseas certainly, and I'm sure they'll be looking for one's that suit their causes.

http://www.afl.com.au/news/2015-05-...ims-and-hatred-can-wada-do-what-asada-couldnt

"WADA and other sports bodies have, from the outset of the ASADA investigation into the Bombers in February 2013, watched with great interest as the AFL went about its business.

One very interested outsider was John Coates, boss of the Australian Olympic Committee and also president of the Court of Arbitration for Sport (CAS), which will hear the WADA appeal.

Sports which fall under the AOC banner have long felt they were subjected to far greater and more stringent drug testing than the AFL. There is no sympathy from people in those sports for what the AFL and Essendon are enduring."

Anyway that last bit was speculating on my part and might mean nothing. While the first paragraph though certainly increases the chances of an overturn it doesn't mean it's a done deal. Still have to have enough evidence still to get it over the line even with a "lower bar". You hope it's all a fair hearing and we get the truth one way or the other.

Who said its a lock??

Totally happy with whatever decision is handed down by CAS.

Hopefully you will be as well.
I've always said I'll accept the umpires decision. I believe CAS will review it fairly so I'll have no issue or tin foil hat to wear
