The ICC has also issued a warrant for Hamas leader Mohammed Deif, who Israel says they have killed.

According to the ICC, the chamber “found reasonable grounds to believe” that Deif was “responsible for the crimes against humanity of murder; extermination; torture; and rape and other form of sexual violence; as well as the war crimes of murder, cruel treatment, torture; taking hostages; outrages upon personal dignity; and rape and other form of sexual violence”.

It also said there were reasonable grounds to believe the crimes against humanity were “part of a widespread and systematic attack directed by Hamas and other armed groups against the civilian population of Israel”.

For Netanyahu and Gallant, who was replaced as defence minister earlier this month, the chamber “found reasonable grounds to believe” that they “each bear criminal responsibility for the following crimes as co-perpetrators for committing the acts jointly with others: the war crime of starvation as a method of warfare; and the crimes against humanity of murder, persecution, and other inhumane acts”.

It also found reasonable grounds to believe that “each bear criminal responsibility as civilian superiors for the war crime of intentionally directing an attack against the civilian population”.

A Palestinian source involved in the negotiations told Haaretz that Israel is demanding that Hamas release 11 hostages beyond the initial list of 34 it requested. According to the source, Abera Mengitsu and Hisham al-Sayed – both of whom were being held in Gaza prior to the October 7 attack – are among these 11 hostages. While Israel considers them humanitarian cases, Hamas views them as young men of military draft age.

The source added that Hamas responded to Israel's demand with its own request to change the criteria for releasing Palestinian prisoners and increase the number of prisoners to be released. There is growing speculation among families of prisoners that most of them will be sent abroad if released, and that they will have no option to refuse release under these conditions.

Whether Israel is demanding the release of 34 hostages or 45, it is possible that the numbers mentioned in various reports include bodies. Israel is not certain about the number of living hostages, which makes it difficult to set maximalist demands for their release. In Israel, there is speculation regarding the condition of some of the hostages. For some hostages, there is no information on their condition at all.

National Unity Party leader Benny Gantz said on Sunday that "While the negotiators are working, Netanyahu is once again sabotaging [the hostage release talks," adding that "We are in sensitive days – life and death [hang in the balance]."
"Like Netanyahu said just a week ago, 'the less we speak [about the negotiations], the better.' And like a rerun, Netanyahu is once again running to the foreign media and speaking [about the talks]," Gantz continued. Addressing Netanyahu directly, he added: "You have no mandate to once again thwart the return of our hostages for political reasons. Returning the hostages is the right thing to do in terms of humanity, security, and nationally."

Israel's done it before.

Sinwar was released in 2011 as part of a deal that saw 1,027 Palestinian and Israeli Arab prisoners released from jail in exchange for a single Israeli hostage, the IDF soldier Gilad Shalit.

Israel has exchanged hostages for prisoners in this war, but that deal was obviously not unreasonable and didn't involve Israel essentially losing the war and allowing Hamas to regroup in exchange for hostages.

To clarify, are you suggesting that if Israel were to make an agreement now they would 'essentially lose the war'? Or is this some kind of backdated hypothetical.

Hamas has demanded a full withdrawal of the IDF from Gaza previously in this war in exchange for hostages which is unreasonable. They have apparently removed that demand recently which is why a hostage deal is starting to look likely now.
