Getting an elbow in the guts is hardly going to be viewed as "exceptional & compelling circumstances", the tribunal will just suspend him for retaliating.

If that's tha basis of their argument, they will be saying it was that far off the ball and of a serious enough level that it was no longer within the bounds of football and was pretty much assault. Hence he should be given minor penatlies for retaliating.
