Sounds to me as if Police/DPP will require a judge to order custody extension due to medical psych conditions.

Under the caveats and guidelines of 'reasonable time', if a formal interview process has not commenced due to the suspect not being physically or mentally fit, then a custody time extension may not be required.

This current situation can be a legal minefield, as once arrested any suspect's health and wellbeing becomes the responsibility of the state. Accordingly, I think our alleged perpetrator maybe smarter than some assume, if his recent injuries were actually self inflicted...

Oh true that, well I guess next time someone dies in custody we'll just have to accept it's unavoidable then.

Might be very lucky this man survived then, would be terrible if he's part of some kind of child trafficking ring, his information could be very valuable.

Kidnapping charges likely to be laid later today.


'The Acting Commissioner of WA Police, Col Blanch, is doing the media rounds this morning.
He was on Sunrise moments ago and was asked for the latest on the Cleo Smith investigation. Mr Blanch said police will likely charge a man in his 30s with kidnapping later today.

“If there are any other charges they may take some time,” he said.

“A lot will depend on what evidence if any they are able to extract from the home behind me where Cleo was allegedly held captive. There is also a possibility that specialist officers will be having a chat with Cleo today, possibly in the coming days and a lot will depend on what she tells those officers.”'
 
Why do people think he would've been bashed in custody?

'Det-Supt Rod Wilde’s plea came as he confirmed a media report that the 36-year-old man in custody accused of abducting the little girl was “bashed black and blue” by another prisoner in a holding cell was “not true”.

“My understanding is the man in custody self-harmed,” he told 6PR this morning.

“Obviously in modern police stations there’s CCTV in all the cells and everything else. That’s what the understanding was, he was taken to hospital, when he’s declared fit to interview, that’s what we will do.”'
 
The West Australian newspaper has named him as Terry Kelly just now.

Further to an earlier post, I still suspect this bloke has a co-conspirator and the police may discover there has been someone else in the house over the past 18 days, likely a female. Perhaps his injury during custody, if it was self-inflicted, was a delay tactic to avoid further interrogation and give her more time to get away...? The local fella interviewed early this morning on the street mentioned 'they' twice..

It's an excellent 'throw'! Quite often suspects when arrested will deliberately fake mental health issues and that can lead to psych reports which are then used in court proceedings and person is not convicted due to mental health issues. Just like Derek Percy played his game!

Terry Kelly, 36, had only been at Carnarvon police station, in Western Australia, for a few hours on Wednesday when he was allegedly set upon by a prisoner....

That prisoner's mother told Daily Mail Australia her son was 'furious' when he discovered why Kelly had been arrested.

'As soon as he heard this bloke was arrested over that little Cleo, he blew up, beat him black and blue,' the woman said.

'I tell you what, he (Kelly) got a real hiding... my son had to be taken out in shackles, and he (Kelly) was taken for treatment... he was in a bad way. He is a big bloke but he really copped it'.

A spokesman for the Western Australia Police Force said detectives would not be commenting on the woman's claims, but confirmed the man in custody had been treated in hospital for a range of injuries including some of self-harm.

Kelly was loaded into an ambulance outside the police station yesterday morning and taken to hospital for treatment. A large white bandage was wrapped around his head.'


Possibly was both bashed and self-harmed.

I'm going with self-harmed. It's just not realistic to expect the police through such a high profile investigation would have even put him into a cell with anybody else in the first place.

I think it was also the Daily Telegraph who was claiming Cleo was found in a cupboard/cabinet..!

They really have become the tabloid most should avoid, with their almost daily publishing of sensational, barely believable BS..!

Yeah, that whole story sounds ridiculous.

Funny if true but I don't see it happening. Far more likely he just brained himself on a wall or floor.

Possibly was both bashed and self-harmed.

If it turns out there is a inkling of truth in this story, it could cause considerable harm to the credibility of Wilde. Not what was needed at this critical stage of the investigation and moving forward to charging and prosecution. Indigenous community distrust of Police will escalate.
