Robbo is visibly furious. The outcome doesn't match his 9 month narrative. The investigation panel was stacked with QCs. It concluded that Clarko, Fagan have nothing to answer for. Try prosecuting a case against them now in any court let alone the HRC.
Given the failure of the whole process and the reputational damage to Clarko and Fagan, the boot is now on the other foot. The second issue now is "Who leaked the document/information"? And will there be an investiagtion by AFL or indeed Hawthorn.

There are going to be some very nervouse people out there tonight.
 
So, if the complainants didn't receive any money, what was the incentive to making that agreement with the AFL? They didn't have to agree to anything - yet here they are, purportedly having "supported" the investigation, and thereby its findings, which exonerate the 3 coaches.
AFL acknowledges their pain and trauma (something that might be able to be used in court or HRC), and it ends the waste of an investigation that prevents any of the parties from taking any other actions.

The statement literally said they won’t do that.
The statement said they wouldn't bring legal proceedings against the AFL.

The implication from Robbo was that it would be used to prove that Clarko, Fagan and Burt were guilty of mistreatment/racism.

HRC isn't Legal Proceedings either.

Agree with a lot of this however I’d suggest Hawthorn and their bank manager will be very nervous.
 
Hard to tell.
From the presser it sounded like they'd come to an agreement.

But the AFL website says they no longer want to continue with the investigation and won't bring legal proceedings against the AFL specifically.
So after 8 months Gill does his “lm washing my hands of this moment.” Gosh I’d love it to be done, but some how can’t shake of the real possibility that a legal bun fight is about to begin.There are no winners in this situation as there will always be innuendo and hearsay attached to all parties. Just a complete botched up investigation lurching from one disaster to the next.
One thing though…there better be some hefty sanctions and removal of picks from the Hawks or this press conference / supposed internal investigation will be viewed by most of the footballing public as a total sham.
 
Yep I agree with your read - I think it’s a bit of both - neither side really wants legal action and I believe after today there is an element of not being able to prove most of the claims. In terms of the families it now makes the most sense to go after Hawthorn for both their alleged treatment “by the club” (and not the named coaches) and for the shambolic way this whole report was handled including the leak to the press which caused both sides distress in the last 8 months.
Would you agree that it's not in the interests of the accusers to have lawyers for Clarko, Fagan, and Burt cross-examine the claims, or worse, present context of possible behavioural issues around which certain controversial decisions were made at the time?
 
So they finally get the documentation they were seeking and it clears them of any wrong doing.

“Prior to the agreement referred to above being reached, the documents held by Hawthorn that the complainants had refused to release to me were released to me, very recently, with their consent,” Fagan said.

“Those same documents were in the possession of both the investigation panel and the AFL for consideration by those parties for a significant time prior to their release to me. I am bound by a confidentiality deed not to disclose the contents of the documents. But I can say that they support the categorical denials of the allegations against me that I have stated from the outset. I can also say that for my part, I would be completely happy for all of these documents to be made public.

“I am happy for any of my conduct and any documents to be aired publicly in a public court or proper public process and let someone impartial decide what is true and what is false.
