Would you agree that it's not in the interests of the accusers to have lawyers for Clarko, Fagan, and Burt cross-examine the claims, or worse, present context of possible behavioural issues around which certain controversial decisions were made at the time?
Yes - I reckon they’ve suddenly realized that this was the obvious problem months ago.

Wow - respect for Chris Fagan - after reading his statement I think there is no chance of legal action of any kind succeeding let alone proceeding - again I’d expect an agreement soon enough that all action will cease.
As for Hawthorn I think they have a problem………..that’s entirely of their own making.

No mate they should be targeting the lack of due process and procedural fairness and the damage to their reputations in the public arena and that means suing the AFL and the Hawthorn Football Club and the ABC. There is no need to test any of the allegations or the people that made them in a court of law from Clarkos perspective. In fact it would fall upon AFL/Hawthorn/ABC to call the indig complainants to give evidence on the basis that the allegations were true and you would imagine none of them are going to go anywhere near that. Best outcome if Clarko goes to court as I have suggested above is full exoneration and a very big bag of cash that he then donates to an Indig Players Development program. Public apology from ABC + $, ditto from AFL and Hawthorn + resignations ;)
 
That’s a very, very strong statement from Fagan.

Classy and respectful of other parties. But really positioned himself strongly.

I’d imagine there is a statement coming from Clarko’s side within the next 24 hours. Will be interesting if they take the same route.

The afl and Fagan’s statements have made it quite clear there is action coming the ABC’s way.

Does the AFL have an official supplier of Rugs and Carpet?
I know everyone is jumping on this rug stuff - but what more could the AFL have done? They haven't paid them out any money. This was not their fault. They had a duty under their own rules to investigate. Sure, it was a shambles - but I don't see what else they really could have done or concluded. Sure, if there was money moving to the complainants, this would suggest some rug sweeping. But there hasn't been. So I think the rug stuff is a bit unfair on the AFL here.
 
I'm not sure what else the AFL could of done.

If those files were all requested from hawthorn at the start of the piece, and the delay was because of the effort involved in extracting the relevant items from them then what could they have done?

Alternatively, perhaps in their efforts to diversify the panel caused further delay for various reasons.

In any case I feel like all the parties were trying to get out of an air-tight room, with both hands tied while blindfolded.

I hope the hawks give generously, and that this conclusion provides at least some form of closure.

Then again, we all know the media...

For all we know, the players never expected their responses to have been made public, and they possibly had little idea what the impact of their statements in the Egan report would be on the coaches.

The fact that they didn’t need money from the AFL to agree to this “resolution”, or whatever we can call this, is significant too.

FMD! Mate the AFL are in charge of the competition they are the final arbiter, they could have stepped in at any stage and ended this fiasco but they chose to let it run out for reasons that we can only guess at :mad:
 
A very strong statement - and so far, the most important and significant thing to come out that supports Clarkson's innocence.
Having heard the stories and having knowledge of who the families were I was always 99.9% sure that the 3 were innocent. The 0.1% was they were guilty of nothing more than some cultural insensitivity.

Dude you can be sure that $ has changed hands somewhere in the chain, it comes in many guises, lawyers bills, mortgages repaid, trust funds set up etc etc
 
Wait a minute, plenty of people in this thread saying all sorts of "Hawthorn will have to pay" etc etc etc. But if Hawthorn pay it is because they are guilty of something. Doesn't that then implicate Clarko? Or am I missing something? Can't have it both ways.

No, they couldn't.

This would of just enflamed everything.

Have you thought about what would happen if the AFL had come in and went over the heads of the claimants, and just said 'nothing to see here, move along'.

That would be literal carnage. They needed the claimants to sign off on an independent panels finding.

The fact that the claimants decided to hand over the documents to all parties in the end says that there was genuine progress made with goodwill between the parties.
