In Queensland, Victoria and WA, if a secret recording is published or shared with anyone else then the person who made the secret recording can face jail time (up to two years) and huge fines.

The only exceptions are if everyone consents, if it is part of legal proceedings or if it is in the public interest or for the protection of your legal rights.

If you are considering making a recording for the purposes of some sort of anticipated or current legal proceeding (such as a family law matter with your ex-spouse, or unfair dismissal proceedings against your employer) you should always seek legal advice first.

Even if it may be legal under the law, the courts may not look favourably upon your actions and it may not always be supportive evidence for your case.

That's not right. Firstly it is not illegal in anyway in Victoria to covertly record a conversation if you are a party to that conversation and you are operating the recording device. Secondly it is not illegal to record a phone call IF you are a party to that call. In either case, it does NOT require the consent of the other party. It is only illegal to INTERCEPT a call (ie. by a third party who is not party to the call) without a warrant.

Receiving legal advice or not prior to making the recording is irrelevant. Dont believe everything you read in the paper - especially a canberra paper.

I understand you are stating a position but the irony of Essendon running to the Integrity Unit makes me giggle

Maxell XL 11's were the bootleggers tape of choice...If buying for my old "Sound 4" cassette deck the SKCs would suffice or the cheap Chinese crap knock offs that almost looked like TDKs iirc TDJs or TCKs lol.

I guess that when there is plenty of money/ new jobs/ AFL pension plans and yours hasn't come up after 4 years, you start to get a bit antsy about having missed the bus?

Most of it is just adding icing to stale old cake we've been mouthing on - the email bit was new though.

That could be a bit of a problem for someone(s) if it gets tested in court and holds up.

Maybe it will all be over by this time next year?

Again, nothing illegal in Victoria about publishing such a recording. Indeed it's done fairly regularly.
 
So what was it?
According to 7, someone representing the club approached Gatto and the Little quashed it.

No money changed hands and we are left with a couple of disgruntled ex-employees who thought they could use it to their advantage. Pretty disappointing really.
