Lee has rejected the notion that if the intercourse had been consensual they would have left together. He said it was explicable he ran out alone because he was cheating on his girlfriend.

On the matter of consent Lee said Lehrmann knew Higgins was drunk, saw her falling over and saw her drinking.

He is not satisfied Higgins said no repeatedly, but he is considering if she consented at all.

On the balance of probabilities, Justice Lee has determined that Lehrmann r*ped Higgins.
But not enough to support conviction on a criminal charge of rape.

Lee believes Gain's account of witnessing Higgins as staggering drunk and falling over at 88mph. He may have put something in her drink then, opposite of a stimulant. I accept it as well as I do Higgins appears to have straightened up a bit going through security at PH.

It's possible he gave her a stimulant after seeing her so drunk at 88mph, if cocaine is his choice then it was probably that which may have been just enough to get her through the doors at PH but it wore off fast and she passed out in Reynolds office.

IMO.

Im not so sure, when something was dropped in my drink I woke in my own bed and didn't remember getting there. My memory came back in patches as when being paralytic drunk I knew how I got home etc

I'd be very surprised if it was allowed before a jury in a criminal trial but that won't stop the prosecution of the Toowoomba matter from trying to introduce it at some point.
