Reynolds asking the Judge to send a contempt order to hundreds of twitter bots was just idiocy on a stick. And a sign of just how well thought out her defamation action against her former employee (who was r*ped in her bloody office in Parliament House FFS) has played out.

Edit: I can just imagine the response of Senator Reynolds as Defence Minister being told our nation is facing a DOS attack on major infrastructure facilities in Australia.

send the order to the owner of the site - IE musk. And yes while it does nothing immediately, maybe can later be leveraged into something. At anyrate, it takes little effort for the judge to do so, and maybe at some later date if musk visits australia having not paid/ complied wiht the notice, we can imprison his arse for shits and giggles and extortion of cash

Well, if we go back to the purpose of the defamation case, ans that's whether the tweets defamed her by claiming she wasn't supported and there was a cover-up. Then I guess we can get some sense of how this will play out.

The Higgins defence team has, in my opinion, made a good case that she wasn't supported through this.

I'm not sure about the cover-up. Certainly, it smells, the AFP person (Leanne Close???) Testimony certainly provided questions. However, is that enough to suggest there was an active attempt to cover this up? I'm not sure, I'm certainly no expert in the matter.

As I found to my cost some years ago when my shop was cleaned out by a so-called friend's son and his shit mates, what the cops know and what the cops can prove to a suitable standard in court are often two completely different things.

Defamation standard isn't as high as the criminal standard.

If the judge finds on probability that Reynolds wasn't supportive of Higgins, that's enough for Higgins' tweets to not be defamation. It's certainly not clear that Reynolds "did" support Higgins.

The bottom line is that Higgins didn't feel supported and Reynolds was/is emotionally fragile, so to me it's reasonable to presume she had no idea how to be supportive or a good manager at the time either. She has certainly been shown to still be unsupportive.
 
The Albanese government has agreed to pay Linda Reynolds’ legal costs in her referral of the commonwealth’s multimillion-dollar settlement with Brittany Higgins to the federal anti-corruption body.

The attorney general, Mark Dreyfus, wrote to the Liberal senator on Tuesday confirming that her application for legal assistance in a National Anti-Corruption Commission matter had been approved by his department’s secretary, a document tabled in parliament on Thursday showed.

Reynolds referred the attorney general’s December 2022 decision – to grant the senator legal assistance in Higgins’ personal injury settlement, but to disallow her involvement in any mediation – to the NACC in October 2023.

It is not known whether the NACC (which refused to investigate corruption allegations stemming from the Royal Commission into the Morrison Government's RoboDebt Scheme) has decided to commence an investigation into the Higgins' matter.

Let's just wait and see what the ACT Integrity Commission comes up with in its investigation of Justice Wally Sofronoff whose so-called 'independent' inquiry has been so badly tarnished with allegations of collusion and inappropriate behaviour.

If that investigation dares to call out and take legal action against a former respected silk for his behaviour then maybe we have a chance of seeing the behaviour of media sycophants being called to account for their actions as well.

But I would not hold my breath.

The juror who caused the rapists trial to be abandoned should be in prison and then forced to pay back every cent of costs.

Look, the mistrial was a tragedy. I have no qualms about saying that, because it installed the worst possible outcome. Subsequent cases have gone some way to proving things but nothing will satisfy like a proper criminal verdict would.

I think you are being kind, FIGJAM. The overreaction was entirely in the character of the poster. But thanks for posting the link.

I fully agree The Punter (a namesake of a a fellow Launcestonian of the great man) and fully agree with Lee's verdict, which made the clear claim that I am in full agreement with that in all probability, Lehrmann r*ped Higgins.

Lee IMHO found the smoking gun that the criminal trial couldn't, which was to marry the original complaint from Higgins that Fiona Brown and Linda Reynolds literally took to the police, then separate the post David Sharaz-era negative influence, by finding her candid text discussion with her Dad in between these eras.

But the criminal trial failure was no major surprise IMV. They had to get a "beyond a reasonable doubt" in a scenario where that was particularly challenging.

I've been more than keen to discuss rape trials being inquisitorial versus adversarial. I'd be taking the 'Lee verdict' versus '12 of my peers' all day every day (both as an alleged victim and an alleged perpetrator).

I've bolded the part I'd like to respond to: the juror's behaviour means that the accusations were neither proven "beyond a reasonable doubt" or failed to be proven beyond a reasonable doubt, which is an entirely unsatisfactory outcome. The points about judge/jury trials are well taken, especially in a context of sexual assault.

A lot of people have ripped into the one juror, but the mechanics of what happened are unknown.

People seem to default to there being just one stubborn arseh*le who wouldn't budge, but it was in Day 5 of deliberations, so who knows what the various votes were.

The one thing that is certain, and I say this knowing that I've been accused of victim blaming by some regular posters in here, is that Higgins and Sharaz's media blitz provided a significant amount of demonstrable lies that were easily exploited by Whybrow and cut to Higgins' credibility. And going to the police was a very late afterthought.

A lot want to blame the security guards, DPS, the cleaner, Brown, Reynolds, Drumgold, The Juror, Sofronoff, Albrechtsen etc. for the failure of justice in the criminal system, but it's just deflection away from the main failure.
