Wrong. Hawks did what they had to do by the rules of the AFL.
Correct. For reference below, once the HFC had the report outlining serious allegations they were duty bound by the AFL’s protocol to hand over the report to the AFL integrity unit.

I will pin this post, as it seems to be a constant query.

Maybe I’m being a bit simplistic or ignorant here, however, what specifically have we done to warrant potential sanctions ?
Hurt the brand, which is all the AFL care about.

If we followed the protocols what have we done wrong? What sanctions at the afl for the leaks?
Perhaps, and I’m only guessing, the AFL will claim that Hawthorn should not have commissioned a report off its own steam and referred the matter straight to the AFL’s integrity unit.

There were no leaks according to the ABC, as there was no confidentiality clause written into the terms of reference of the report.

Just a technical question for anyone in the know.

How much legal responsibility if any does the club as an employer have to treat players wives/girlfriends as anything other than regular members of the public?
Depends on the circumstances, but there has been common law claims brought against employers by "secondary victims"

The notion of a secondary victim relates to the duty holder also owing a duty of care to not only an employee as a primary victim, but to also to someone who could reasonably be injured by the duty holders acts or omissions. More often than not this is someone who has a close relationship to the primary victim such as a partner, spouse or sibling.

'Magic' or just hard work? Aboriginal football players, mainstream media and accepted racism

Are using terms such as "magic" and "freakish" to describe Indigenous AFL players minimising their hard earned skills?

It seems a bit harsh when lauding Indigenous players is now racist lol.

If you have played with Indigenous players they stand out with their skills. As for putting their success down to hard work, I do wonder why white basketballers and those white participants across a range of athletic events such as the 100m don't put in a bit of extra work to level up to their black counterparts?

I’m expecting something along the lines of an $800,000 fine for conduct unbecoming.
My guess is that the outcomes are predetermined. These would have been agreed when Reeves stepped down is my take. No way of knowing, but I think the biggest issue with the investigation is that we didn't have the outcomes predetermined prior to the report coming out. There were too many variables that we didn't control adequately. As they say - don't start a report/investigation without knowing the outcome.

In this case the indigenous watchers were provided with boxes to stand on, but had their feet clamped to it, so were unable to choose not to watch occasionally

The employees were paid hundreds of thousands of dollars to come to work and do their job.

Their feet weren’t clamped, they were employed under a contract.

If the working conditions didn’t match what was set out in the contracts and/or standards for Fair Work, then there is a solid case for a Fair Work investigation.

I’m not sure that it’s one for human rights, personally.

Further to my last comment, I wonder if this would be healthier and productive discussion if thread titles and headlines reported ‘Hawthorn FairWork investigation’ or ‘Hawthorn working standards investigation’ rather than ‘Hawthorn racism investigation’

With all due respect, sounds like you just got a broom and swept the core issue under the carpet. Call it what it is - racism. No reason to hide from it.

The Players Association seems to be more upset with the AFL handling of this than the HFC.
Seriously if we lose draft picks over this I’ll stop following the AFL
I’ll always continue to pay my 22yr club membership because I love my Hawks, but I won’t be following the AFL anymore!!

Here comes the pain.

So funny and so sad. Everyone hates Kennett and Reeves by association, particularly online where the AFL watches sentiment closely (almost exclusively it seems at times). So they see if they can pin this on them in order to get Hawthorn to roll over. It's not a good-faith exercise in justice, it's yet another attempt to find an acceptable bad guy. The attempt on the coaches failed when the coaches loaded up for court action. The attempt at Hawthorn's current board failed when they showed spine over the last few days. So now they turn to their last option.

If the AFL had good faith in this regard, they wouldn't have turned the original investigation into such a predictable circus with one leak after another. Now they try again, picking the weakest target but one that everyone can rally around hating. (If Kennett could have in any way been left holding the bag on this then he would have been targeted immediately out of the gates)

Meanwhile, the AFL will have accomplished its primary mission: attention focused anywhere but on it. I've got my fingers crossed for you AFL! Do your best to save Gil's reputation and not leave him holding a turd sandwich like Demitrio on his exit! We love you Gil!

I think this idea is DOA. I can't spare the time to look for the quotes right now, but I distinctly remember the AFL complimenting Hawthorn on the process when this all first hit the media. I suspect there will be far too much evidence that at the time the AFL was complimentary of Hawthorn's broad approach and only turned against it when this went custard under the AFL's care.

My bet is that Hawthorn pays no fine and the AFL once again modifies the procedures, ironically micro-managing even further and guaranteeing the next situation is farked twice as hard.

(Plus the Newbold hole card guarantees, I think, that Hawthorn does not get a fine on this. More likely, every club is required to have some sort of relations manager. "We've thought deeply about this learning experience...")

Is this something you've heard SYL?

$800k when you've got $70m in the bank earning 4% interest is nothing, especially when we can hardly meet the TPP floor.
Nothing I’ve heard, just a guesstimate based on what Melbourne were given plus a little inflation.

Seems like the afl deserve a sanction!

The afl could have referred the matter back to hawthorn to investigate the cultural safety issues and accusations of racism. Their policy allows for this. But they didn’t because they know the hfc can’t investigate itself. There is a conflict of interest and it needs to be managed. They could have asked the hfc to reach out the players and discuss with them what they want. But they didn’t do that either. The afl are looking to scapegoat the hfc for this when they were in control of the situation and didn’t exercise its option to return the matter to the hfc.

If sanctions happen, they should be for the historical treatment of players not the handling of the investigation, as that is on the afl. The only caveat here is that the the hiring of Egan should not have occurred but I don’t think his involvement cruelly influenced the recorded Truth of the players, but maybe the way it entered the media would be different. We can only speculate on that though.
