Hard to fathom they would listen to that information and then just delay a decision because it wasn't important enough. Especially after how long he's waited. Something's cooking in the background.

Nah, it is an open and shut case. The lab analysis of the tampered test says its not pee and there would be the statement from the ASADA tester.

There is also the failed test from a few weeks later.

It is an open and shut case. Willie is guilty of tampering with his test and using a prohibited substance.

The fact that it has taken so long doesn't infer anything about the merits of the case or evidence, just that bureaucracies are bureaucracies.
The case is all about procedure and policy.

You're right that the provided sample and subsequent test showing a sports drink are fact and not arguable (and from reports both sides accept the fact that the sample that was eventually in the lab contained a sports drink).

The grey areas are how it transpired. In your example if the asada tester substituted the sample en route then the athlete would still pay the penalty (not at all suggesting this happened here).

I see it as 3 options.

Willie completely in the wrong (knowingly and strategically substituted the sample)

ASADA completely in the wrong (basically we know this isn't the case)

There was an infraction, but the process to getting to that infraction either wasn't correctly followed or there were mitigating circumstances (misunderstanding or similar).


There are a number of cases in recent memory globally where a positive lab test has not resulted in suspension - so the test result alone is not indicative of the facts or outcome (not saying Willie is innocent, just that the circumstances will have a massive impact on the penalty, hence it is not as open and shut as suggested).

Just out of sheer curiosity, what would happen if the ASADA penalty came out less then the actual time the athlete has spent out of the sport?

ie, lets say for numbers sake, Willie was given a 1 year ban..........and he has already spent 18 months out of the game

Or, he was found innocent after having spent so much time out of his profession

What's the protocol? Are the athletes reimbursed? Given how long this process has taken, it must have happened in world sport at some point

My guess is they'd get the equivalent of a shoulder shrug and a bad luck pat on the back, along with some sort of statement saying you signed up for this process when you signed your contract.

No way that would happen. I think part of the reason it is slow is because they know he's looking at 2+ years.

WADA have been sued on multiple occasions when decisions are overturned or people are not guilty after serving a provisional suspension.
 
Have they? I couldn't find any successful ones apart from a defamation case but I didn't look overly hard.

Yeah that’s the only one I could find as well.

WADA banned a Liverpool player for taking higenamine but then discovered it wasn’t actually on the prohibited supplements list at the time the player took it. Don’t see how that case would help Willie.

The club was told that the penalty would be announced this past week, no one has heard anything, my source has no idea now. I have a funny feeling the Collingwood news with the report on racism and subsequent standing down of their president has forced this to be pushed back a few weeks, with the worry that a likely career ending penalty against a black player may be construed as racist, I'm legit starting to worry this shit will be announced within a week of the mens season start, which will distract us from much needed wins to start the season. Well done AFL!
 
Putting off the announcement for fear of 'racist' shouts is one of the sillier theories I've heard. Wouldn't delaying the announcement for those reasons be more racist than just coming out and doing it?

Stupidity doesn't discriminate against any colour, race or creed. It's universal.
