Could we now see the first legal challenge (Restraint of Trade) by either of Rawlings or Davis? Everyone knows that a legal challenge would decimate the AFL's player transfer rules. Both Pt Adelaide and Hawthorn had heaps of notice but wanted to play games. Now two players wont go where they wanted to - watch out AFL - I smell legal eagles already perparing their cases.

Remember where you all read this first.
 
If this does happen it will change football forever - remember the Hawks and Pt Adelaide were the bloody minded people who started this.

No, not everyone knows this.
It is something commonly bandied about by the media, and by the Eddies and Big Jacks of the world when they don't get what they want.

But the truth is, nobody quite knows how such a challenge would turn out.

Sure, it is a restraint of trade to a degree, but this isn't necessarily illegal.

Just for example, nothing is stopping any of the players plying their trade in another league, such as the SANFL. The restriction is only within the AFL.

If my company has internal rules that mean I can't move departments, etc, without going through certain procedures, that isn't a restraint of trade...

theres nothing illegal about what hawthorn and the bulldogs did: hawks don't have to trade someone if they dont want to.

Traditionally, North Melbourne Football Club, played football, but here we have supporters taking their eyes off the ball.

Grab at your sour grapes Kangas with your prompting players (some greedy and disloyal) to take legal action.

Grapes squelch when you grab at them and you will have sour juice all over your face.

The way in which you (supposed) football supporters (?) are thinking, the outcome could eventually not just wreck the AFL but, hence, ruin the North Melbourne Football Club.

Will Raph Clarke sue his new club when he is not drafted by St Kilda? Doubt it. Rules are rules.

Hawthorn were under no obligation to trade Rawlings to the roos. North couldn't come through with the goods, so he was forced to enter the draft like any other player. Stiff **** you greedy prick Jade.
 
I think there is little doubt that if it went to the courts they would find that it would be Restraint of Trade.
The problem is that this would be very bad for football.
If there is one thing that has ruined sport overseas it's having 40-50% player turn over every year.
 
Actually, for the first two posters in this thread, Port had approximately 5 trading hours notice, Nick Stevens didn't name his `one club only' policy until after close of trading on Thursday. Cheers.
 
A restraint of trade case won't happen. First of all no-one is stopping anyone from earning a living, and second of all all players nominating for the draft have to sign a contract agreeing to the terms of the draft.

Maybe someone who stood out of the draft may have a case, but certainly not anyone who has already agreed to be tied to the team that selects them.

no wonder the players want to leave hawthorn, and the sogs are sore losers as they lost nathan brown so they thought that they would stuff up someone else.

and as for port adelaide what they thought the pies would trade didak. farken idiots
 
jade and nick take legal action so we can get rid of this stupid trade week and pre season draft
