So basically the majority and probably a fair bit more then the majority will back the AFL over us, so what happens now? rines


Now we wait. None of this 'media' stuff that the AFL doing changes ANYTHING. None of these press conferences or meetings or statements makes any different in a court of law.

The reality is the situation is just getting worse and worse and no end in sight. Both parties need to get back to the table and figure out something. I've said all along.. the AFL needs to take the officials off the table.. and the point stripping and EFC have to accept massive fine and draft picks.

That is the only way this gets settled out of court imho.

Actually relates to the fact that the 'AFL Rules' are like a deck of cards.. if they are challenged in court, they all fall over. Essentially all parties agreeing that IF this goes to court.. then everyone hurts and everyone's dirty laundry gets public. Very dangerous and doesn't help the 'AFL Management' one bit in court.. the court is interesting in one thing only: EVIDENCE.. not how quickly the other club presidents want it sorted out.. especially when at least four members of that group are highly beholden to the governing body...!

Evidence and Innocence before proven Guilty i think will hold us in a good standing.

Playing Devil's Advocate for a minute, it's not surprising that someone with negative things to say about the club and Hird would want to be anonymous, to avoid any consequences falling on her son.

Yeah. Hopefully the club makes some discrete inquiries to find out who it was and offer them the support she thinks is missing.
 
Gees Caro's going to look bad if that mother was a fake. Regardless the rest of her article was childish trash.

She will look equally bad if she's been talking to one of the parents and she coerced that person to make the call.

Yep

I think most fans now would accept a fairly hefty fine and a loss of draft picks for a year. Even though i still dont think we necessarily deserve that.

The main thing is to have the names and the club cleared. Hird will be happy to have next to his name "managed club and staff poorly" or something that resides with that in a similar fashion.

If it doesn't go to court.. we are going to get slammed like no one else before and most likely no one else ever again either.. it will be fines, points, picks, hird, reid, corcoran, thompson and probably more...
 
SEN at the moment are only taking Essendon callers. Probably hoping to hear from Essendon supporters jumping ship but we are staying strong. Most supporters support the club and James Hird and want to hear Essendon's side of the story.

A few are saying that they will stop supporting Essendon. If you are feeling this way we don't want you as supporters....

2.5 million fine and loss of 1st and 2nd draft picks this year.

Deal done I reckon, move along nothing more to see on with finals.

All staff cleared.
 
So, the club presidents don't want this decided by the courts, and Essendon don't want this decided by the AFL Commission.

Assuming no deal can be reached directly between the parties, who else could decide?

Are there any organisations that do mediation, retired judges, etc. that could be involved?

I think whoever feels they have the strongest legal case will be the last to blink. Both sides have good lawyers to advise them, they both have access to the same information, there is no reason why they wouldn't have a fair idea about how this will play out in court. A court case isn't like rolling a dice. There are precedents that can be drawn on and the acceptability of the evidence used by both sides will be known by now too. It's probably a massive win for the club if we can bring the AFL back to the table with a more attractive offer. Which is probably why it won't happen unless the AFL is currently backed into a corner. If Hird is confident of the strength of his case I reckon he'll take it as far as he has to in order to get a result that is acceptable for him.

Both parties submit 5 candidates to be on a 'panel'. Each parties chooses 2 from the other's list and then 1 more is chosen at random creating a panel of 5. They must all be from sport/legal/medical and have strong reputations.

Then both parties go into confidential mediation.. present their respective cases.. panel decides, if AFL gets 3 votes then Hird stands down, we are out of finals and pay fines. If EFC gets 3 votes then we get a fine of 2M and that is it.

Or something like that... just make it clear and end this farce.

Well actually they have stated that this needs to be 'sorted out' and 'quickly' and 'in house' and 'out of the media'..

but apparently that is the same thing to the media..

A fine is the only punishment which fits the crime IMO. The crime is not drug cheating, it is the poor governance.

Taking points off us for wins only fits the crime if the wins were achieved through cheating. This is not what has been proven. And it hasn't even been alleged in the season to which the points taken would be from.

Taking draft picks off us is an absurd notion. Picks are taken off clubs in order to weaken their list. This has been done in the past for clubs that have tried to tamper with the draft or salary cap systems in order to strengthen their list. The idea is negating the unfair advantage they tried to achieve. Unless there is any proof that we cheated and our list has benefited because of this, how on earth can it be considered just?

If they take our picks, then we can kiss success in the foreseeable future goodbye because of manipulation of the so called equalisation measures in the system. Our club will be a laughing stock for decades, and all because Dank (sacked by the club) didn't have a lock on his fridge?

Don't know yet what I'm gonna do without football, so I hope it doesn't come to this.
