I reckon in the back of your mind Mero, you're thinking how amazing these would look on the site. Sponsors and all. I know Australia's copyright laws sorta suck, but surely the displaying of sponsors can come under 'fair dealing for purpose of research or study'? (Sect. 40 of the Copyright Act 1968)
Failing that, you could potentially host the site in Canada and bypass any Australian law? Mr Eagle, are either of those suggestions actually possible?
Possible, yes. Not be challenged by the AFL? Probably not. Not cause Mero any grief at all? Unlikely.
And it's a matter of copyright and trademark. There's at least one mark on that Hawthorn design that is guaranteed to be trademarked in Canada as much as it is Australia.
Would it sweeten the deal by you offering to allow the league and the clubs concerned non-exclusive use of your images for the purposes of archival and historical display? Maybe the AFL would be more open to you using their IP if they were granted a non-exclusive license to use jumpers from the siteThere's a German apparel sponsor who complained to Big Footy about using their logo, but I suspect most of their concern was being associated with concepts that they did not design. It's actually because of the rights they sold with the website deal. Basically it means no-one else can have AFL ip on their website.
