I can't see too much Betts should regret there.

He avoided character assassination and used the opportunity to reflect on broader issues facing indigenous people in footy and in society more generally.

Certainly seemed more circumspect than a lot of other commentary that was made in the 24 hours after the story was released.

Can anyone explain what is likely to happen next?
Looks like it goes to Human Rights Commission from what I can see. It is far from over. Just the AFL has washed their hands-off the investigation. Tend to agree with some comments here that defamation action by the three would be unlikely as it would them mean all allegations would be tested in open court. Will be interesting to watch next steps. One thing is certain - not finished yet. Feel for everyone involved tbh.

Not to mention he ends up having to be the voice of racism every time something happens. It must be exhausting
 
My feeling is that if Clarko feels the need to clear his name, and his lawyers are strongly confident of the evidence and receiving a win, then he should feel free to do it. But if he does it has to be with the understanding he isn't guaranteed the verdict he wants, and that an adverse finding would put him in a worse position than he is now.

I liked Fagan's stance of "******* try me."

Has anyone questioned him about the timing? They must have. I haven’t paid as much attention to it as others, so I could have missed it.

It’s so on the nose. IIRC The whole reason they did the investigation was because of the fall out with his comments to the Rioli’s, then they exclude the period when he was president, and to cap it off the story was leaked to the ABC while Jeff was conveniently on a cruise and apparently unable to be contacted.
The other aspect of timing is that as I recall, the Jackson article blew this whole thing up when Jeff was overseas.
 
However should the case advance to the Human Rights Commission, Clarkson, Fagan and Burt, who’ve long denied any wrongdoing but were never formally interviewed on the matter, would need to attend compulsory mediation.

It would require the First Nations families to put their testimonies on record, meaning their identities would be made public for the first time.

“It’s far from the end of this story,” Chief Herald Sun reporter and AFL 360 co-host Mark Robinson said on Tuesday night.

“My information tonight is it is destined for the Human Rights commission.”

If consolidation can’t be reached, the families could sue for discrimination in the Federal Court, while the entire process reportedly could drag out for another couple of years.

As others have mentioned, you read through that article and when it comes to describing the outcome they separate the quotes and content out to make it seem as dodgy as possible.

They try very hard to make sure they never connect that the families agreed that the coaches had no case to answer, instead they agreed to end it. And that the AFL 'terminated' it.

Using single word quote on how the AFL "cleared" the coaches is also another trick to make it seem dodgy. The whole thing is a disgrace from the ABC, still cannot quite understand how Rusty thought his original bullshit article was good to go, and how he probably still thinks he was in the right - he's hurt everyone involved with his carelessness.

This is not going to end well for the families, can you imagine the grubby journos lining up to reveal their identities.

It will almost certainly be a simple capitulation by Hawthorn and a large amount of money will leave their bank account. Along with apologies and concessions from them. I envisage an agreement between families and coaches not to drag this out further as each knows the other side can destroy reputations forever with what's known. AHRC or Federal Court or defamation will be parked permanently. AFL will slug Hawthorn. It's not going to be a very interesting end. Quite dull in fact.
 
I've had a quick look at the last few pages of the corresponding thread on the Hawthorn board. Summarising:

  • Nervousness amongst many over what the AFL will do
  • One poster even suggested forming a breakaway competition and ditching the AFL
  • Some think Kennett is a campaigner and is now beyond reach, so it's frustrating
  • They demand to know who leaked the report
  • Club director Andy Gowers has a presser at 11am
 
Kennett leaking the report to a contributor journalist for the ABC.? Give us a break. The leak most likely came from the bloke who hasn't been talked about for a while. The same bloke that's under a police investigation on another matter.
That is the strongest rumour (JK leak) - don't know if true but some folk in the media believe so.

I do find it a little hyperbolic that people are touting the next big step for the complainants is the Human Rights commission, like that’s some thunderbolt from the gods. The routine process there? … conciliation

it’s not a court, and after the HRC you have to go to the federal court. So any legal process is likely to take literally years, which will put the onus on everyone to find a settlement

And if Clarkson and co are named as individual respondents, I’d guess they will cross-sue for defamation

That is still a damnation of the investigation that Kennett and Reeves established as they handed the job to someone without the integrity required to ensure the confidentiality and trust that was promised to the families, and that should have been a given for all current and former employees of the football club.
