Beyond reasonable doubt. No-one is 'guilty' in a civil case like this.

If Cleaver was to have found to be slanderous with the allegations made against Kelly and CFC then no doubt he would be pursued for damages in return.
Careful with the terminology. It's balance of probabilities, not BRD in civil matters.

And your second paragraph is nonsense. The term slander, which is verbal, doesn't exist anymore in Australia. And companies, like CFC, can't be defamed. Allegations in a claim are not going to constitute defamatory material against the defendant.

The words racist and sexist have long lost their sting when they are thrown about like confetti. I don't believe Craig Kelly is a racist nor do I believe the club would defend him if they thought there was any merit in the accusation given the lengths the club has gone to in order to make amends for allegations of past wrongs.

Kelly could be personally defamed couldn't he? And yes - my bad, I did mean balance of probabilities.

For me, the “Get this done to get Browne and Sizer off my back” bit sounds a bit too specific to not be true. There’s nothing illegal about that bit, but IMO would be poor leadership. Surely there would be far more suitable and effective ways to get somebody to set up a safe cultural space than simply “Do this to get the board off my back”?
Maybe this wasn’t the first of those conversations and there has been little action since the last time they spoke about it?
 
Assuming the club could try and settle with Cleaver before court.
His lawyers also wants premiership points stripped from the club. Would you be happy with that, particularly if we were to make finals?

For something which happened between 2 employees which had nothing to do with our onfield performances?

How do you have significant pain in your hand when you have no feeling at all?
