Such settlements are often viewed as a convenient way to avoid any further embarrassing revelations in a court case.
The presumption of a cover up is always an unfortunate corollary.

Not really.

Sometimes it’s just the cost of doing business. It might cost more to defend the claim than what it might cost to just make it go away - value of staff time, opportunity cost, consultants, legals, possible reputational damage, cost of turning off sponsors, etc, etc.

From what I have read of the claim it reads like spurious bullshit that, if it gets to court, will go fail spectacularly.

It’s certainly no justification for a ceo to stand down in the meantime

Yes that’s true.
But the accusations of “hush money” are inevitable.
 
The longer this drags out, the less tenable it is to keep Kelly in his role without constant scrutiny.
I wouldn’t be surprised if the stress associated with this allegation leads to him taking a leave of absence.
No way. If you are not guilty of any crime or offence the last thing you do is step away.

If someone takes a break due to stress, it doesn’t constitute the other side winning. It doesn’t suggest that Kelly is guilty either. It would only indicate that he is human and struggling with the allegations, especially if they are false.

From what I have read, the litigant was fired for dishonesty. What particular dishonesty we don’t know and until it gets to court we will not know.
Two investigations have taken place and have been externally reviewed. No case to answer are the results of these investigations.
I have heard police also investigated and found no case to answer.
Really, this sounds very much like the firm involved taking it on as no win no fee, and hoping that Collingwood will settle before going to an open court.
I think we should allow the court process to play out. Of course if we do we will also be accused of “mental distress” against the litigant. And I’m sure the law firm will play that card very shortly

Yep, their media conference today clearly showing a strategy of trying to get a PR victory and settlement out of court.

But doing it this week, **** em, hope the club claims damages if the case fails.

Our Chair is a top lawyer - backing his assessment

Club, AFL, and cops were unimpressed by claims

Looks like a poor employee who is having a crack (in same way poor performing Whites, vegans, strippers, bankers etc do)

No reason for Kelly to stand down at this stage - which would be a moral hazard to anyone claiming anything without substantive foundation

Looking at the employee's media profile and experience - think there would have been several thousand better qualified indigenous candidates to perform this role

Question for the club seems to be: how can we better recruit and select high performers in every role
 
So much dribble in these last few pages. One thing for certain if Ned is found to not have a case to answer, Tom 'liquorland 'Morris or any other life destroying media outlet won't be publishing an accurate account of the outcome. They will be onto the next person they can crucify. I hope to one day run into one of these media judges/executioners

This may well be correct. And if so, I stand corrected on my earlier view.

I still have concerns about disrespectful or ignorant treatment of Aboriginal culture.

The CEO must set the benchmark.

1 - as CEO of Collingwood, he would have intimate knowledge of our troubled past relating to these matters. Would he say those things to an indigenous person, knowing they would probably get out?

2 - if the answer is actually yes, he did say those things, would he allow Browne, Sizer and the Club to back him unconditionally, knowing what it would do to their reputations and the Club if it were to be proven that he said them?

I'm leaning towards no. I dont think he'd throw Browne, Sizer and the Club under the bus.

I cant see the Club settling, it will go to court. In a Civil trial, the burden of proof is less than in a Criminal trial - I have a feeling this will get messy.

It's really bizarre isn't it?

I can't get my head around Kelly speaking like that to someone who is employed at the club to help drive the First Nations strategy at the club. Someone who identifies as non binary, gay, disabled & Indigenous.

That is some kind of dumb if any of this is remotely true.
