Not with Clarko or Fagan because any settlement would have to acknowledge that they caused some harm and that would be the end of any AFL employment.
Depends on the terms of settlement which usually contain no admission of fault and the terms confidential.

  • You did something wrong
  • To prevent bad media

A third reason to settle:
  • It might cost more in time, money and hassle to defend it versus settling.

That’s not just legal fees, but also the CEO’s time, general counsel’s time, Board’s time, opportunity cost of that time being spent for more useful activities. The club have already appointed consultants to advise on this and they don’t come cheap.
 
Beyond reasonable doubt. No-one is 'guilty' in a civil case like this.

If Cleaver was to have found to be slanderous with the allegations made against Kelly and CFC then no doubt he would be pursued for damages in return.
I don't think the pies will seek damages. You know the crows that's already convinced they're guilty couldn't handle a 2 way street.

I’ve always assumed it’s the present continuous form of awakened in the context of enlightened.

As in people that consider minorities and their needs thoughtful are awakened and enlightened. Whereas those who do not are in the dark and out of date.

Personally, I’m woke on the outside and a dinosaur on the inside. You have to be these days.
 
There is a video on the club website (6 weeks in) where he talks about having a bias before joining a football club lol

Then talks about how amazing everyone is.
 
Scenario:-

Kelly: "I just want to be CEO, manage the joint and get it rocking so we win premierships"
Board: "We need to be seen to be a progressive and powerful club, able to negotiate the current climate"
President: "I want to preside over a club that has great success"
Coach: "I need to have clear headspace and the trust of the players"
...
Cleaver: "I've been hired to implement a positive indigenous culture"
Fan: "I just want to win Premierships"

No-one is wrong here. All anyone ever wants is what their heart wants. What's terrible is when those things clash, or those aims don't align with the other aims, or people just don't care about the other thing. That goes all the way across that list.

I've heard all sides now and I can honestly say I don't want anyone in that list to miss out. This situation is shit.
 
Assuming the club could try and settle with Cleaver before court.
Browne's interview would suggest otherwise - he indicated that the club intends to defend its actions in court. He said that to date the public has only heard the complainant's side of things, and he asked people not to judge what's happened until the club's side of the story becomes public. To me, he sounded very confident of a favourable outcome for CFC.
