The Suns, Stingrays and Marlins have all been TRADE MARKED by the AFL with the Australian government very recently. Others such as Dolphins, Stars, Pirates and Buccaneers have NOT been TM'ed.

Looks like a choice of three. GO THE RAYS!!!

FYI, there are no registered trade marks yet. Application have been filed, but they now need to be advertised for approximately three months, during which time any opposition can be raised and mark can be amended or rejected.

Suns should have no problems as there doesn't seem to be any similar mark applied to any goods and services in classes 25 or 41.

There doesn't appear to be any application current for Marlins. If the AFL does apply to register a mark for Marlins, I expect that opposition will be raised by the Florida Marlins who have marks registered in both of these classes. Note especially the Marlins (logo) registered in class 41 in respect of "Sporting entertainment services, namely a sporting team; entertainment services involving sporting activity including radio, television, film and live action performances featuring sporting activity ". There would be little prospect of an AFL mark succeeding with this name.

Stingrays has now been advertised, and given the breadth of the application, which is across a much broader range of classes in which a football team might be expected to sell merchandise, I think that this would be the most likely name to be running through the AFL's mind. The only other registered Stingrays are a rugby union club (not NRL!) on the Sunshine Coast. There will be no drama from them because their Sunshine Coast Stingrays have defined their services in classes 35 and 41 very narrowly in terms of rugby union football. (And, oddly in my opinion, have not even registered their mark in class 25 to stop other people from using it on their jerseys.)

Anyway, the upshot seems to be that I think that Stingrays is looking good. :)

What about the Gold Coast Stingers?

Stingers is already registered in class 25 for "Clothing, footwear, headgear" for Brisbane Junior Rugby League. Not being able to use Stingers on clothing would be a big impediment. :)

Interestingly, the South East Stingers registration for class 41 services only covers rugby league activities, so therefore the possibility exists of calling the team the Stingers, but not using the name on jerseys/merchandising etc.

Such is the world of IP.

Dolphins could be tricky. The Redcliffe Dolphins, a rugby league team north of Brisbane, has registered the word Dolphins across a range of services in class 41 that cover a fair bit of what a professional sporting team would do. For what it is worth, the Gold Coast Titans were originally going to be called the Dolphins before Redcliffe told them, very politely I am sure, to back off.

The Dolphins (logo) is also registered by Redcliffe in class 25 in respect of "Clothing, footwear, headgear, football boots, caps, football training shoes, socks, shorts, jerseys and guernsies, T-shirts, polo shirts, tracksuits, hats, jackets, neck ties, singlets, jumpers, coats". This would be enough to nix any AFL registration.
 
If you're searching the data base...well it's a **** of a search function. Type "gold" into the first box and drop the menu down to "Exact" and type "stingrays" into the second box and drop that menu down to "Exact" and hit "Search".


Even better, put "004155211" under ACN and get everything registered by the AFL.

Pride is not a registered trade mark. Indeed, the Registrar has given it an adverse report, which means that the AFL must amend its application and refile, before going through the advertising process and getting it registered. It is a way off being a registered trade mark. Ditto Giants. Ditto Wolves.

(I do note, however, that there is a "Ranga Pride", which seems to provide cosmetics, clothes etc, that is registered. How good is that for the name of a footy team? :) )

Surf has been filed, but not yet advertised. Ditto Stars.

Note to everyone: just because a trade mark appears in the database, it does not mean that it is yet a registered trade mark.
 
what does "never registated lapsed/not protected" mean in the status part..
from what i can see, the suns is the one that looks most likely as its the only one with "indexing approved"..

Indexing approved merely means it has been added to the database. Nothing more.

Never registered, lapsed means that the trade mark, as it says never got to the stage of being registered. There may have been opposition that was never overcome, fees might not have been paid and the registration application lapsed.

Thats a truely fantastic logo - awsome! Needs a thread of its own.

Brisbane take note - it shows what can be done when you try. The trident has been a theme in Demons logos since at least the 70's, like the rest of the logo its a nod to the history of the club.

From one of the worst to one of the best in a single bound!
