That isn't really what is happening. There is no impact to Judd of the deal no longer being included in the cap. It is more of an impact on Carlton than Judd.
Exactly right. Judd will get his Visy pay regardless & if he chooses not to play on after his football club contract runs out at the end of this season, it will have nothing to do with his employment with Visy & it will then be up to Visy/Judd as to whether he stays on as an employee of the company.
 
Not really, the AFL signed off on it prior to him commencing employment with the Blues; now they are saying that the rules have changed prior to the contract that they signed off on being concluded.

So if Carlton rightly say "Chris, we can't fit that additional amount into the salary cap as it's already taken up by payments to the rest of the squad" then what is he to do; he's tried appealing (which failed) so now he's lighter in the pocket because of it, I agree that it's a Carlton problem but it is most definitely Juddy’s as well, as no matter what action he takes he looks like a bad guy.



1- He says that’s crap and I deserve what I have signed off on, that forces Carlton to delist or under pay another player on the list (public perception) what a sh#t bloke making it all about himself

2- He accepts the ruling and is worse off financially himself, which is unfair as the very contract that he signed in good faith has changed for no reason / fault of his own

3- He may look at ending his football career as he doesn’t want to cause a fuss to his team or himself and realises that maybe he’s already done enough in his career, if he does this then lame people in the public forum say he’s weak if he walks away and he’s all about the money



As I said in my last post, apply the exact same situation to your current employment and I believe there is no doubt that it affects you just as much as the company that hired you; whether people agree that it should have ever been signed off on is another story all together, as the Blues we only paying him based on what the AFL signed off on, surely logic would suggest that it should have been amended once the contract that was signed off on was completed.

Now I go for the Baggers (as you can tell) but if it was the same scenario involving a player from a different team, I still wouldn’t blame the player, especially after the governing body signed off on it; agreed I would also say it’s unfair for my team but if they have followed the process that was put in place then the people that I would direct my frustration towards would be the people that signed it off………the AFL.

I don't think anyone is blaming Judd. He's getting paid the money either way. It is up to your list manager to work out the mechanics of fitting it under the cap. He's not going to give up contractual payments on account of this new ruling. Option 1 is therefore the only real option. It is not like he will be ending his football career at the end of this year on account of a payment that will have already occurred throughout this year. The horse would have already bolted.

IMO, Carlton and Judd would look at this rationally and say, well, at least we got 4/5 years through, so we did pretty good. That may not be what they would say publicly, but that is only because they were still trying to continue to rort the system, as any club would if they could (and many tried in the years following the Judd deal).

The argument the deal should continue to be approved is a cop out. The AFL has gotten stricter on these deals as they are just a way to circumvent the cap, just because this one was signed before doesn't mean you get out of the tougher restrictions. It would be ridiculous if the AFL said every third party deal is now under the cap, except for the Judd deal as his is old and we approved it years ago under different rules. In being "fair" to Carlton and Judd they would be even more unfair to the rest of the league!

I personally would allow such deals to continue, but the club is not allowed to recruit via free agency while it runs

Comprehension fail. As already stated by myself & other posters, Judd's Visy salary is not paid by the club, but is between Judd & Visy. Judd may well retire from football at the end of the 2013 season (football has never been the be all & end all for him) & continue to be employed by Visy beyond that. Judd is entering the final year of a 6 year contract with the club. He is entitled to be paid what he has been contracted to be paid, just as you & I would be by our employers.

The one thing you cannot accuse Judd of, is not being a good team player. He has busted his gut for the Carlton Football Club for the last 5 seasons, both in games & on the training track. He has always prepared himself the best he can & brought a level of professionalism to the club that had been lacking prior to his arrival. Judd will again focus on his football this season & leave the off field argy bargy to those employed to take care of that side of things.
