Thread has been rolled over to Part 16 here

A few years back I got done for 46km/h in a school zone (40) at about 6PM.

You can't argue circumstance or try and justify why.

I was able to have my conviction commuted down to a warning by writing a letter to the constable in charge of traffic cameras, referencing my exemplary driving record, taking ownership of my "lapse in concentration" and promising to be more vigilant in the future.

Pro tip there folks.

Only works for "minor" traffic convictions though. Won't work for running red lights or being 30 over.
6pm? Where was this? I've only seen 2-4pm (and mornings).

Damned number plate scanners.
They were staking me out.
I live on a main road, not possible to park on it.
Claimed they "saw me backing out of the driveway".
It was before 5am.
Just happened to be parked in a side street near me? Highly unlikely.
Only a few days after my licence was suspended.
But I will SAY IT AGAIN, I WAS IN THE WRONG AND NOW I'LL HAVE TO COP THE PENALTY,naturally.
Apparently Im not allowed to let off steam about it in a "Things that shit me" thread though.

I think its 1 every 5 years in Victoria only
I had a vic licence when I was pulled over in Qld and it only works if you get pulled over in Vic

My old man drove on a Rhodesian license until after the country ceased to exist.

actually, whats the deal with school zones - are they only on during school terms? what if you dont know its school term or not? are they only active when there are flashing lights? what about pupil free days? what about where a state school starts on a monday but a private school next suburb over starts a tuesday, is the school zone operational for both from monday?

In NSW,
  • school zone flashing lights – all schools in NSW have at least one set of school zone flashing lights
  • 40 km/h speed limit – motorists should drive no faster than 40 km/h through school zones, which operate from 8:00am to 9:30am, and from 2.30pm to 4:00pm, on gazetted school days
I believe all days in Term including Pupil Free apply

In ACT the 40km/h limit will apply in all schools zones between 8am and 4pm

I took a Red Light Offence to Court and while the Camera is ruled as absolute proof, the Magistrate stated my driving record was exemplary and asked the Prosecutor (you get one contesting any charge) if he would be willing to drop the charge and he agreed.

No fine, no points.

Could I get answers to my politely posed questions please.

Much more likely than the cops sitting outside your place at 5am in the morning waiting to "get you." :tearsofjoy:

mr bagcroft a few questions if I may

When did you obtain the original Ticket for +30KPH in the School Zone? (I assume that's when your suspension started)
August 2020

Assuming you were oblivious to the school hours, the 'normal' speed limit is 70KPH there?
Correct.

You travel this route regularly?
Correct.

When you were pulled up for driving 500m to avoid a little rain, was this a HWP recognising your license plate belonging to a suspended driver and not a random occurence? (or were you speeding again?)
Yes recognised suspended. Not speeding.

How many other times have\had you driven while your license is suspended?
Never. Hasnt been suspended before.

Yeah, becuase the police would never run any checks at slow times, to like...enforce the law would they? Like they are paid to do?
Say at 4.30 am in a dead suburb on a weekday?
Nah.
Idiot.

Yeah ok mate cops cared so much about you they sat a car outside your place at 4.30 in the morning hoping you'd get behind the wheel. 😂😂😂

I heard of someone getting done on a freeway because they didn't obey the road work sign. Apparently this was at 1:00 am with not one worker in sight. Got to be careful I guess.

the road work sign may still be up due to the road not being safe to drive at full speed, they just aren't there to be careful of workers

Laugh it up Bouncey, who knows...probably not, but definately maybe.
Why wouldnt they randomly check on new licence suspended drivers?

You needed a clean history (no points) which infers three years, then the warning lives for another 2 years according to the letter I got.

And if you haven't had a fine within two years (or it's your first offence).

Thank you

Based on the above answers a standard 6-month suspension should have expired in February 2021, I assume the suspension must have then been dated from the date of the Court attendance rather than the Infringment so as to still be in effect. That means there would have been a 'grace period' between August 2020 and the Court Attendance in which you were still allowed to drive.

Given that you travel the route regularly, you knew the School and School Speed Limit Zone existed. If you drove it regularly without noting its existence, your powers of observation are probably not suited to operating a motor vehicle.

All Highway Patrol Cars are fitted with Licence Plate Recognition cameras, so will 'ping' up a validly registered vehicle, even when operated by someone who is not the subject of the suspended licence involving frequent traffic stops. For example if I was driving your car, the warning still comes up as the LPR System does not know who is driving the car, just that the owner is currently suspended.

With the bolded\italicised question, I meant have you driven in between August 2020 when your suspension started, and the time you drove recently and got caught driving while suspended

I.e you got away with one or two or many occurences without getting caught.

Yes I drove in the period of August 2020 to April 28 2021.
And thats because I protested the fine and was given a court date, which was delayed until now due to some sort of pandemic...apparently.
So, I was able to drive until my case was heard. My suspension didnt start untill the 28th of April, which was the day of the hearing.
So I was never driving unlicenced...until I was.
