Unfortunately for the perpetrators the police know what they are doing. Blatantly obvious from early on who committed this crime . Police will hold off making arrest until case is watertight Indian fellow was a witness and then threatened by perpetrators Without his statement there is doubt and no eyewitness statement on accomplice Indian bloke had to be charged to get him to Australia to make statement Police privately assuring him of a positive outcome but also for his safety need to continue Indian bloke murder charge narrative to keepi perpetrators comfortable and in dark Story given by ex absolute BS I believe they avoided public by driving off best tracks between spring falls and wangetti avoiding cook highway losing dog for hours yeah sure in the middle of nowhere how convenient and ridiculous given experience I believe with dogs Toyahs dog tied up doubtful Indian blokes work So many questions re ex piss poor alibi story Says found car unlocked so clearly some random person stole belongings not ex looking for dog for hours hey ex spent far more time looking for dog than girlfriend holding off calling cops without looking sus not normal behaviour I reckon Indian bloke publicly looking like things are grim privately probably in 5 star accomodation with ample protection

Singh is going to trial for the murder of Cordingley so the police are confident they have he right man, if it may appear his defence will put up a fight to avoid conviction.

There was some new news on this case on Monday that was not posted in here.

Some of you reading this are so 100% convinced on the sound-ness of the Police case to bring Singh to trial, that you might need a good lie down before and after you read the below.

With the murder trial for the man accused of killing Toyah Cordingley drawing closer, his barrister has told Cairns Supreme Court police may have more evidence that has not been included in the prosecution’s brief of evidence.

Speaking at a pre-trial hearing before Justice James Henry in Cairns Supreme Court on Thursday, Angus Edwards KC said his instructing solicitors found out from a member of the media there was apparently a statement made by someone who was possibly the last person to see Ms Cordingley alive.

“We found out there was a statement we had not been provided with, had not seen and were not told about it,” Mr Edwards told the court.

He said it did not form part of the brief of evidence the prosecution had provided Mr Singh’s legal team.

“We have concerns there may be additional material we have not been provided with … we have subpoenaed the media person in relation to the document they may have,” Mr Edwards said.

He said there was allegedly a statement from a person who saw Ms Cordingley walking on the beach with a man walking behind her, at 2.30pm, not long before she sent what would be her final text message, to her boyfriend Marco Heidenreich, at 3.17pm.

Mr Edwards said he wanted a further pre-trial hearing – known as a Basha inquiry – to cross examine three police officers.

“We want to know what material is outstanding, we don’t want to be left in the dark until matters are disclosed by the media to us,” Mr Edwards said.

He told the court he wanted to interview five police officers, but the crown sought stronger reasons to interview the latter two.

He said the latter pair had not provided statements but were “leaders working in the background, directing things”.

Justice Henry stated the Basha was in order to properly test if there existed any further material.

“There are some signs there were recordings with other people not disclosed, some suggestion not all CCTV or Dashcam footage has been disclosed,” Mr Edwards said.

Mr Edwards said he wanted to cross-examine the officer who took the statement that was missing from the material.

“Another police officer made inquiries in relation to a potential other person who may have been involved in the killing, we want to make inquiries of him, where that went, what happened in relation to that.


“It’s a very loose end, we don’t know what is going to come out of that,” Mr Edwards said.

He said the defence was still working to proceed to trial on the set date of July 22.

Crown prosecutor Nathan Crane said he consented to the Basha.


Justice Henry set the date for a further pre-trial hearing for July 18 at 1.30pm.'

The Duty of Disclosure

NSW prosecution guidelines outline that prosecutors are under a continuous obligation to fully disclose to the defence all material known to them in a timely manner, that:
  • Is relevant or possibly relevant to an issue in the case;
  • Raises or possibly raises a new issue that is not apparent from the evidence the prosecution proposes to rely on;
  • Holds out a real as opposed to fanciful prospect of providing a lead to evidence that goes to either of the previous two situations.
The prosecution’s duty of disclosure continues after trial as well as the conclusion of any appeal.

Police and other investigative agencies are also under a continuous duty to disclose relevant material to the NSW ODPP, so that they can appraise the material and disclose to the defence if suitable.

I wonder when this alleged statement, and Police (AFPl/State) and QLD DPP knowledge that where was a further witness at the crime scene, was made to Police and/or media, in relation to the timing of the legal process to extradite Singh from India to Australia, and the payment of the AUD$1m reward money?
 
It would seem logical that the person seen walking behind TC wasn't Singh, there would be no reason not to include that as evidence, right??
Depends who the person allegedly walking behind Toyah was.

Maybe revealing who this person was, might have risked compromising some other criminal investigation (Australian or International), related to some serious crimes and an ongoing operation or that Police or other LE (State/AFP/Other/International) Taskforce or operation.

Possibly something drug, organised crime, or child pr0n/sexual abuse/pedo related.
