You're missing a fairly critical part to that - Malceski had stopped and the umpire had blown the whistle just before Guerra tackled, so then he slung him to the ground while it was a dead ball. i agree its arrogant and a little disrespectful, but a 50m penalty for shaking a finger in a contact sport seems excessive
Why can't the umpire just ignore it and get on with umpiring the game?
Memo to umpires: You want respect? Scolding and punishing adult footballers as if they are 5 year kids is not the way to receive it.
