Yes certainly but the substance of what was done that caused that was still ball tampering. You can't avoid that

I think you can avoid that mostly as they are not the charges being examined in court. The factors proceeding the crime will be taken into account but they aren't factors that will help the defendants in this case, not like a driving infringement with a concurring mental health issue per say.

Be interesting to see a case play out, CA and the players are partners but when playing international games they both allow the ICC to make calls on player conduct, warner could have easily been banned by CA for a long time for trying to fight de **** but in that case CA allowed the ICC to be the final judge, that they cherry pick issues and go well over the ICC sanctions based mostly on public anger would concern me if i was a player.

As for warner appealing surely that would be so he could play in other comps, he would know his test career is over.
 
Not sure how likely all that is, truth is we had two long term proven batsmen and they are now gone, the more likely outcome is a struggling batting line-up which could even lose at home to india.

WArner will never play for us again and Smith well we have no idea what the future holds for him, he won't be playing a test until the 2019 ashes and he will have had no shield cricket in that entire time, I think people need to accept this could have a devastating impact on the side That could last for years.
It may be who knows , Renshaw may come in and from here be a career 40+ test bat for 12-15 years . Maxwell may come in and shoot the lights out .
Obviously Smiths incredible hard to replace until he returns but I think Warner is very replaceable.

Indias spinners who torment us over there are nowhere near as effective here and most of there bats will find it tough work against our world class pace attack

I don think its doom and gloom at all , off field we have a heap to do though
 
That's my thoughts on Warner. If the team is demanding that the board make sure you're not even in the same building as them there's no point appealing the ban, you're done and dusted.

To me this means scapegoat and convenience. I think we can all agree Warner is not the devil incarnate. So what the **** is actually going on?

Seems to me "the team" and Sutherland have a lot to answer for........So lets hear the truth without scapegoats and the full story. Who knew what and how long has this been going on?

Nothing, of course, which is probably what would happen with Warner. It would be more about playing in other leagues or the Shield. But CA would probably appreciate Smith getting his sentence reduced. They look tough and still bring him back into the fold.

There is a valid argument to say legally that the bans are on shaky ground. Hence solicitor enthusiasm

If they some how get their bans over turned or reduced.... then I look forward to the public booing the hell out of them during their first game back :)
 
A number of articles today suggest both Smith and Warner have been approached by solicitors who know the penalties exceed precedent. It was said that Warner in particular was contemplating the appeal

No surer thing then Warner lawyering up

Knows he wont play for Australia again and he will go down swinging , he wont be worried about taking a few down with him

I imagine why people don't like turnbull involved is you just figure he wouldn't even know what end of a cricket bat to hold if you gave him one i also just assumed the outrage at smith from pollies isn't what he did but rather that he was dumb enough to confess to doing it.
 
Technically true, but we already saw on camera they rubbed something on the ball, so the only thing their admission changed was letting us know what it was, so given they lied about it it's not unfair to assume ulterior motives for the whole presser.
My point is do not admit to cheating no matter what is on footage is (I know it is wrong), but no other player I can think of has ever admitted to cheating, ball tampering after/during a match, bottom line is for being so honest it has backfired badly. Let the ICC deal with it and we all move on.

smith shouldve taken lessons from pollies about telling the "truth"
 
I have no problem in the PM commenting on the matter manily becuase of a things

1) It is the countries national sport and

yeah this is real sad, poignant comments about giving away his spot in the team. i remember him being really unsure if he'd get the opportunity again after the 2015 Bangladesh tour was cancelled
